SMITH, 226 Monomoscoy Road, continued from 16 <br /> February 1995. Michael Grotzke presenting. <br /> Mr. Sherman stated the plan is much improved. An engineer's <br /> stamp will be necessary. More information is needed on the <br /> retaining wall. <br /> Mr. Grotzke stated it is proposed to use gabions. <br /> Mr. Sherman stated a revised plan would be needed. He asked <br /> if Mr. Smith will agree? If not, he will be fined. It could <br /> be permitted, with an improved version of the wall . It is <br /> within the realm of permissibility. <br /> Mrs. Ferriday asked for elevations on the bulkhead? <br /> Mr. Sherman stated gabions make sense. If Mr. Smith gives <br /> Mr. Grotzke permission to go ahead with the variations, it <br /> could be continued. He would not want to deny it because <br /> some of it would have to be removed and would destabilize the <br /> bank but Mr. Grotzke will need permission from Mr. Smith to <br /> proceed. <br /> Rick York advised there are shellfish under the dock and he <br /> has a problem with the innermost floats which restrict <br /> shellfishing underneath. In his memo he suggested replacing <br /> the two floats with a fixed walkway and put float stops on <br /> the floats. There are no shellfish under the other ones. <br /> Mr. Grotzke stated a plan to extend would take care of that. <br /> Mrs. Ferriday asked why they are using floats, rather than a <br /> walkway. <br /> Mr. Sherman asked if it was known what was there before Mr. <br /> Smith added sections? <br /> It was stated a boat house was there originally. <br /> Mrs. Ferriday asked if the Commission would agree that Mr. <br /> Grotzke go back to his client to address this? <br /> Mr. Sherman stated Mr. Grotzke should impress his client that <br /> if he does not do this, he will have legal problem. He asked <br /> for a letter from him within two weeks. <br /> Public comments: <br /> Mr. Jackmauh stated Mr. Smith extends his boundaries whenever <br /> he wants, shutting his neighbors out. <br /> Mrs. Ferriday stated property rights do not come under the <br /> purview of the Commission. <br />
