VOTE: Motion made and seconded to find a Negative <br /> Determination. <br /> NEGATIVE DETE +III ATION. <br /> 7:30 THOMAS F. SMITH for the construction of a, two oar <br /> garage; grading and construction of a stone driveway; and <br /> stone retaining wall at 266 Monomoscoy load, No one was <br /> present for this hearing. <br /> Mr. Sherman stated Mr. Smith was seen earlier but was not <br /> present now. <br /> Mrs.. Ferriday stated the property was not staked. <br /> Mr. Sherman stated the wetland line was accurate some time <br /> ago but the corners of the garage and wall were not staked. <br /> He recommended continuing until properly staked. Vere are <br /> some other deficiencies. <br /> Mr. Rosenberg asked if some abutters present for the hearing <br /> could be heard without the applicant present. Mr, Rosenberg <br /> felt they should be allowed to sea} . <br /> Robert Johnson of 424 Monomoscoy load stated this lot is in <br /> the wetland and was an unbuildable lot; Torn smith bought it <br /> and now has managed- to get a permit for a garage. His <br /> concern is that it will be turned into a residence in the <br /> future. <br /> Mr, Sherman stated they cannot do that without a septic <br /> system. He can be prevented from making other alterations <br /> that would rake it liveable; without toilets would be a Board <br /> f Health issue, <br /> Mrs, Ferriday stated, if continued, and the Commission does <br /> give a decision, they will make sure it is written into the <br /> Order of Conditions that no septic will be permitted on the <br /> property. <br /> Mr. Johnson asked if Mr, smith could cone back arra have that <br /> restriction lifted? Mrs. Ferriday stated the Commission has <br /> to deal with what is in place now. <br /> Mr. Johnson stated if it does not become a habitable <br /> situation, they would appreciate it. <br /> VOTE: Motion made and seconded to Deny Without Prejudice, <br /> Unanimous Note <br /> DENIED WITHOUT PREJUDICE. <br /> Mr, Rosenberg advised Mr. Johnson that if Mr. smith pleads to <br /> the board to give hien a continuance and the Commission <br /> agrees, fir, Johnson will be made aware. <br /> Mr. smith arrived at .m. and was told by the Chairman <br /> that the application was denied without prejudice. <br /> The Agent explained procedures and advised he can reapply. <br />
