1 <br /> Mr. Lash clarified the changes made today. The last draft <br /> dated 1/95 was considered to be a little weak regarding the <br /> Piping Plovers; it is now described in detail , They will <br /> have a Plover Warden paid with a grant which will be pursued <br /> every year. They will make sure every year that there is at <br /> least one paid staff person in charge of monitoring both the <br /> marc species, Plovers and Tern, summer staffing is mentioned <br /> again on page 10 and a full-time Plover Warden is mentioned <br /> as well. <br /> Henry Barber of the Natural Heritage and Endangered species <br /> Program, a division of Fish and Wildlife. They are mandated <br /> to the protection of rare and endangered ered species. He did not <br /> see this until earlier today, They feel changes made are <br /> still short of what has been asked of DEM since 1989 , They <br /> are still concerned with the placement and employment of <br /> Plover monitor. If funded through grants, they would like it <br /> to read that a full-time staff person ill be employed. on <br /> the bottom of page 5 it states "subject to adequate funds" <br /> there is no protection for following years. The position <br /> should not be subject to grants and adequate funds. They <br /> want a change in the plan reflecting the employment of a <br /> permanent seasonal staff person to use on the beach, not <br /> subject to grants or adequate funding. <br /> Mr, L baron stated concern is with the original agreement <br /> with the option of special permits for ORv f s on the beach for <br /> people that are disabled. No special permits should be <br /> issued when Piping Plovers are nesting, one of the nests is <br /> right at the encs of the breakwater; there should .be no <br /> vehicles on the beach. <br /> Ir. Sherman asked who issues the special permits and was told <br /> DEM issues. <br /> Ms wlchansky advised the beach has been designed to prohibit <br /> Rv access; special language has been implemented to <br /> encourage- furFther discu8sion with the town to implement a <br /> more permanent barrier than is currently at the town beach. <br /> There will be a gate and it will be locked. They should not <br /> be able to get around the gate. The purpose of the special <br /> permit is to allow access for fishing only. <br /> Mr, Rosenberg asked how the ATV's get in there, Mr. Lash <br /> advised they enter where the state Park is. <br /> Ms Wolchansky advised, to date, there had never been a <br /> special permit issued. <br /> Mr, Lash advised in 1981, prior to the purchase of the <br /> property, they made an agreement to allow the elderly and <br /> handicapped access to fish with special permits. Mr. Sherman <br /> asked if they are the only ones that can get a permit for <br /> vehicle' 1r. Lash stated now, with the Disabilities Act, it <br /> is a lot broader category. Most of the Boston staff who have <br /> worked on the plan agree with Mr. Lebaron that there should <br /> be no vehicles on the beach. To pursue that, as part of <br /> their regulations, once a year in February they give the <br /> public and themselves a chance to revise their regulations. <br />
