27 July 1995 <br /> Page 14 . <br /> It was noted ,, even! x n this dry summer , the sphagnum. moss was <br /> wet with water . <br /> WILDLIFE REFUGE: The Trust "dor Public Lands has committed <br /> the money to purchase the Sufflehead Say section of the <br /> refuge . T hey asked for a match in order to get a grant; that <br /> we will never build on our land . They asked for a commitment <br /> of town lands to match the ac.reage they 'mend to buy . <br /> copies of a letter were distributed for review that is to be <br /> signed by the Chairman of the Commission . This was written <br /> y Tori Fudala . <br /> The Agent advised this does not mean the Commission is <br /> turning over their lands . Everything would be under the <br /> management of the Commission . He has been assured this does <br /> not give away anything on our part . <br /> M r . Rosenberg did not have any objections . <br /> 4 <br /> Mr . Green advised Olt is 6,000 acres . <br /> Mr . Sherman stated the Selectmen have signed off and asked <br /> the Chairman to sign h i s letter , 17 i h . <br /> Mr . Rosenberg saw no problem with the letter but had some <br /> sic problems with the issue of who has the right to commit <br /> this . This should be discussed at some point 1n Executive <br /> Session . <br /> VOTE: Motion io made and seconded that the Chairman exorcise <br /> his position and sign the memorandum . ani ou o e . <br /> BATH: An Order of Conditions was issued for a patio and some <br /> cutting at John 's Pond . Mr . Bath was not happy with the <br /> Order but has agreed not to appeal ; he objects to special <br /> condition 3 . <br /> Mr . Rosenberg strongly recommended n odeleting h condition <br /> because of thepossibility of someone bringing a lawsuit and <br /> the defense used that- the Comm i ss i o n allowed him o do 1 . <br /> This remediation is absolutely necessary . <br /> It was noted this is already under appeal . <br /> Mr . Fitzsimmons s ted whatever he does , i should in no way <br /> damage the environment . <br /> Mr . Rosenberg stated general condition #2 from wr hi e State says <br /> "The order does not grantany property rights or any <br /> exclusive privileges; it does not authorize any injury to <br /> private property orn asion of privaterights " . <br />
