10 August 1995 <br /> Page 13 . <br /> The Agent would like Grote of the Commission to let him make <br /> final decision on going with the best bid presented and <br /> relying on his Judgement . Ms T rrio advised approximately <br /> Zoo l .f . will be involved . her . Sherman is still <br /> investigating but wants o rove forward . <br /> Mr . Sharpe stated it i's closer to 400 1 .- . <br /> The Chairman stated the Commission should share this decision <br /> with the Agent . He would like a letter from Town Counsel <br /> that the town will not be liable foany volunteers doing th <br /> work . <br /> No action was taken on the request . <br /> SANTUIT IBJ superseding determination was issued with no <br /> copy to the Commission . The Agent learned of this after the <br /> appeal period had expired . memo From the Agent was <br /> distributed for review . <br /> Mr . Fitzsimmons stated the only reason this action was taken <br /> was at the recommendation of Town Counsel . <br /> Mr . Sharpe stated he would like to support the Agent on the <br /> appeal ; it will not cost the town anything and can be <br /> withdrawn . <br /> Mr . Fitzsimmons stated they are saying i t. is within <br /> agricultural use . He was not sure what the Agent wants . <br /> Mr . Sharpe advised he wants to r t. an appeal . Their letter <br /> talks about siltation fences but there were no sioltation <br /> fences used; there was nothing to keep erosion control down . <br /> Mr . Fitzsimmons felt thereshould not be an appeal until <br /> Town Counsel is involved . <br /> Mr . Desrosiers did not feel there was anything to be lost <br /> appealing . The critiocal. point Bob is asking is ,, how far <br /> would they allow an existing waterway to be done . He feel <br /> two of the three points are good to question . <br /> Ms Torr io stated there is no argument about the natural <br /> waterway , us hors far . <br /> Mr . Fitzsimmons stated i the Agent wants to spend time <br />' <br /> working on this , he has no problem with it. . The lawyers <br /> should be involved . <br /> VOTE: Motion made and seconded to give h Agent permission <br /> o compose an appeal in order to be ableo consult <br /> with Town Counsel ; if Town Counsel feels it is ut iol , <br /> it can be withdrawn . Un nimous Vote . <br />
