Rosenberg stated it sounds as though they will have to go through statutory <br /> amendment. <br /> ENFORCEMENT: The Agent advised that while doing an inspection today, he found <br /> six enforcement situations, nine for 1996, which takes up his time. It may be necessary at <br /> some point to reserve tie for the staff to wort on enforcement. <br /> BATT: Ar. Bath was not happy with the Conmdssion's decision. Neighbors appealed <br /> and DEP slued a superseding Order of Conditions which was stricter than the <br /> Com nission's. They are ordering him to move the platform further away and put all <br /> authority back in the Commission's hands. Superseding Order distributed for review. <br /> VINING: An enforcement order was sent indicating he had to do a wildlife habitat <br /> evaluation. The Agent met last Tuesday with Dan Gihnore of DEP, Nft. Vining and <br /> Sanford Ecological Services, his representative. IEP told him he did exceed all thresholds. <br /> Wetlmd lies were established in the field. The Agent found them to be acceptable. It <br /> was made very clear that there is little choice. Sanford will contact him next week. <br /> I&. Vfif tg grants to put in a rcWming wall and was told that will have to be done under a <br /> separate ming; DEP agreed. <br /> The stag of his Chapter 91 filing MR be checked. A notice of Intent was filed but the <br /> dock was withdrawn. The assessors show no dock there in 1988. DEP will be noted on <br /> the size and shape of the dock. <br /> ARNSTA HOLDING: They were the owners of the Tritown Circle property. <br /> They are in bankruptcy; there is a lien on the property. <br /> VOTE: Motion made and seconded to request that action be taken to foreclose that tax <br /> title property. <br /> The Cion could then initiate remediation. <br /> NEGATIVE FETE ATIONS: Suggested language when post work inspection is <br /> needed was distributed for review. The Agent suggested adding it to the work description. <br /> VOTE: Motion made and seconded to use as standarda for all Requests for <br /> Determination of Applicability the a suggested by the Agent. <br /> VISTA G: The Agent stated the Commission should not permit vista prumng in <br /> the NVBS under an RDA, it should be a Notice of Intent. <br />
