30 May 1996 <br /> Page 12. <br /> NASH: My sense is that if I ask you to close tonight you will be unhappy and deny it. <br /> Therefore, I have two separate issues here, you are right, it's apples and oranges and I <br /> understand that. I guess I'll go back and I'll bring in Mr. Lelito again with me, someone to <br /> try to argue the points of law; I guess that is what you are suggesting here. <br /> SHERMAN: The points of law are quite clear, I think he has got to satisfy the Burden of <br /> Proof by compelling evidence in terms of wildlife habitat. Read this over and give a copy <br /> to Paul, in terms of the values of the 50 foot buffer strip and what it docs. <br /> FITZSHVIMONS: Does anyone from the public wish to comment on this application? <br /> ROSENBERG: I move that the hearing be continued at the request of the applicant to <br /> June 13th at 8:50 p.m. <br /> NASH: If that date turns out to be problematical, can I push it up two weeks and call you? <br /> SHERMAN: If we did that it would have to be readvertised and renotified. <br /> ROSENBERG: Why don't we make it the 27th then. <br /> VOTE: Motion made and seconded to continue the hearing, at the request of the <br /> applicant to June 27, 1996 at 7:40 p.m. Unanimous Vote. <br /> NASH: Would it be okay to ask the board, between now and then, to individually, or <br /> whatever go over to the lot and take a look at the site to see what it looks like? <br /> i <br /> ROSENBERG: Some members may do that. <br /> NASH: Should I do anything to the bank, or anything to anything, between now and then. <br /> SHERMAN: Just keep that haybale line intact, as we have discussed. <br /> HEARING CONTINUED TO JUNE 27, 1996 AT 7:40 P.M. <br /> 8:50 MASHPEE WATER DISTRICT, Noisy Hole Road, continued from 16 May <br /> 1996. Lynn Hamblin presenting with Dave Rich. <br /> Mr. Sherman stated this was originally occasioned by an Enforcement Order for work <br /> done along Noisy Hole Road. In the staging area they were moving material around and <br /> putting it within a few feet of a wetland. A revised plan was provided with the wetland <br /> lines correctly shown. <br />
