9 September 1996
Page 17.
Mr. Rosenberg had no more comments. He commented only on this proposal
and made no cements aside from this proposal and that is why he asked Mr.
Regan whether he was going to discuss this.
Mr. Johansen masked it Mr. Regall td itr% vwrg%go w a 11vvy%
1rLndreds f feet away from
the wetlands Tar. Regan stated from the river. i r. Johansen stated he is 50
feet from the wetlands. Mr. Regan stated not in practicality, it is that
cranberry bog hole. Mr. Johansen stated the drawing says 50 feet. Mr. Regan
stated in reality it is a manmade, unnatural hole that was dug. W. Johansen
asked about the Bim?
Mr. Sherman stated it is a moot point{because the lav is the law about what a
coastal hank is. This portion of the coastal hank appears to be an old carved-
out borrow pit but geomorphologically it is a coastal bank, statutorily. This
wart over here was not carved out as coastal hank and that is within 199 feet
so two-thirds of the lot cones under the Commission's jurisdiction.
uu he comments: Harvey Forman suggested cutting hack the lawn in the
front and putting in wood chips.
Ddr. Regan stated they have put in some wood chips, but that is a Catch 22
because the subdivision requirements are that you have a lawn from the
street to a certain point so he is really being dealt a lot of regulations.
W. Sherman stated for clarification, if the Commission does not wish to
accommodate Mr. Regares requests, then the Commission should move to
accept this plan for the lawn, the rest would have to become non-lawn. An
Order of Conditions would be issued saying that and he would either comply
or appeal.
That is the simplest way to handle it. if the Commission wants to come to
another decision to allow him more lawn, that is up to the Commission.
VOTE: Motion made to accept the plan elated 9/19/96 in the possession of the
Agent and deny any other lawn that is not on that plan.
Mr. Fitzsimmons asked, if this is approved, it does not prevent W. Regan
from other plans?
Mr. Sherman stated if he did anything within the. 190 foot jurisdictional
boundary, he would have to submit.
