19 September 1996
Page 7.
Mr. Sherman stated that was W. Batlfs opLnjon, it, i of hisi Mr. Bath
stated that is the facts. Mr. Sherman has abused his authority.
1 . Fitzsimmons did not feel those statements are relevant.
Mr. Bath asked what he had to do to get permission to use his property?
Mr. Fitzsimmons stag that depends, if he can't agree on the location of the
BVD"`. The Commission is required by the laws of the State to observe.......Mr.
Bath stated yes, you are. He has asked this gentleman fir. Sherman) where
they are and he thought what he said was those weeds are the vegetated
wetland and if that is the ease it is the whole shoreline; it is the whole works,
there is nothing left for him because he was never aRowed to maintain that
beach in the first place. if the Commission, in their judgment, decides to allow
him to use two feet of that shoreline, is that violating the environmental law?
That is not what they were intended to do.
W. green asked fir. hath, if he understood what he said, Bob asked him to
step........Mr. Sherman stated he said if Mr. Bath could locate the dock in a
certain area and go up to the bank with, extend it, so it goes up to the bad, it
would go over the bordering vegetated wetland. if enough space were left
between the boards, it would not impa t it. Mr. Bath did not agree with that
approach.
Mr. Green stated but that was do-able. fir. Sherman stated it is do-able but
then he would bring up question #2, does the Commission consider the plan
acceptable? Because, if it is considered acceptable, thea the Commission is
saying there is no BVW on that area because it isn't shown. He felt that sets
a dangerous precedent.
W. Fitzsimmons stated that could be overcome, could it not? if Mr. Bath
agrees to show the BVW on the plan
Mr. Sherman stated it could be clone if a BVW lire was shown on the plan.
Mr. Sharpe stated a four foot extension was discussed., is that correct?
Mr. Sherman did not remember exactly how far, it was something lie that.
Mr. Bath stated he does not want to clear than he wants to discuss with this
Board, after this is concluded, some way that he can approach his problem
and clean some of those weeds out of there.
