MASHPEE CONSERVATION COMMISSION Minutes of 3 October 1996 Commissioners present: John Fitzsimmons, Eliot Rosenberg, John Johansen, Ralph Shaw, George Green Jr. The Chairman called the meeting to order at 6:45 p.m. 6:45 REGULATIONS HEARING: In accordance with the provisions of the Town of Mashpee Conservation Bylaw, Chapter 172, Rules and. Regulations concerning wetlands, a hearing was held for the purpose of revisions to the fine schedule under Chapter 40-21D. Number 1: Revised to correspond to the definition "alter". Number 5: Wording changed, destruction, removal and/or cutting of plant life. It is clear all are alterations. Recommended fine of$100. Number : Fine increased to $200. Mr. Fitzsimmons asked how that would apply to clew.gees. The Agent stated it sloes not, only plant life. Public comments: none. VOTE: Motion made and seconded that the regulation be accepted as submitted. Unanimous Vote. 6:55 PUBLIC COMMENT PERIOD: George Benway carne before the Commission representing his son. Mr. Sherman stated they met at the site in response to a complaint from a citizen. Some work done was not in compliance. The cramp and float are exempt but to get to thein you have to walk through the marsh. A small wooden ramp was put there Which did not pass muster They have removed this as asked. A path down the hank can be approved but a CoC was issued so it cannot be issued under that Order of Conditions. The other remaining aspect is whether a path previously existed although it seems as though it may have. They will,need goof. Ir. Benway stated a picture, although not very good, shows a path down the bank. A reap provided showed the area as it is. The yellow area was dredged in 1961 or 1962. The 10A float serves a 40 foot boat which draws 5 feet of water.
