MASHPEE CONSERVATION COMMISSION <br /> Minutes of 3 October 1996 <br /> Commissioners present: John Fitzsimmons, Eliot Rosenberg, John <br /> Johansen, Ralph Shaw, George Green Jr. <br /> The Chairman called the meeting to order at 6:45 p.m. <br /> 6:45 REGULATIONS HEARING: In accordance with the provisions of the <br /> Town of Mashpee Conservation Bylaw, Chapter 172, Rules and. Regulations <br /> concerning wetlands, a hearing was held for the purpose of revisions to the <br /> fine schedule under Chapter 40-21D. <br /> Number 1: Revised to correspond to the definition "alter". <br /> Number 5: Wording changed, destruction, removal and/or cutting of plant life. <br /> It is clear all are alterations. Recommended fine of$100. <br /> Number : Fine increased to $200. <br /> Mr. Fitzsimmons asked how that would apply to clew.gees. The Agent stated <br /> it sloes not, only plant life. <br /> Public comments: none. <br /> VOTE: Motion made and seconded that the regulation be accepted as <br /> submitted. Unanimous Vote. <br /> 6:55 PUBLIC COMMENT PERIOD: George Benway carne before the <br /> Commission representing his son. <br /> Mr. Sherman stated they met at the site in response to a complaint from a <br /> citizen. Some work done was not in compliance. The cramp and float are <br /> exempt but to get to thein you have to walk through the marsh. A small <br /> wooden ramp was put there Which did not pass muster They have removed <br /> this as asked. A path down the hank can be approved but a CoC was issued <br /> so it cannot be issued under that Order of Conditions. The other remaining <br /> aspect is whether a path previously existed although it seems as though it <br /> may have. They will,need goof. <br /> Ir. Benway stated a picture, although not very good, shows a path down the <br /> bank. A reap provided showed the area as it is. The yellow area was dredged <br /> in 1961 or 1962. The 10A float serves a 40 foot boat which draws 5 feet of <br /> water. Their dilemma is that they went back and forth to the float.with their <br /> boots on and after 1 or 2 weeps they were m .g a muddy ditch so 3 - 2 x 6s <br />
