Sherman found the area to be staked properly; the plan well-founded. He <br /> would recommend a condition that wherever work is done that the naturally <br /> vegetated buffer remain. A letter from Mr. Find was react into the record. <br /> A letter from J. K. Holmgren Associates was read also. They are requesting a <br /> copy of the Order of Conditions. He recommended closing and issuing. <br /> Public comments. none. <br /> VOTE: Motion made and seconded to close the hearing. <br /> REARING CS . <br /> 9:10 EDWARDSI GF IE , 220 Wading 'lace Road, continued from <br /> 10/17/96. Norman Hayes presenting. <br /> lr. Sherman stated the hearing was continued to verify delineations on the <br /> revised.plan. Some flagging was changed to the point where he was satisfied. <br /> The plan is stamped. 'There are some fees that will have to be discussed. He <br /> contends that the Rivers Act will apply. All of the proposed work is within the <br /> footprint of the disturbed area and the only work on the resource area side is <br /> mitigating planting. Because here is no incursion forward to the riverfront, <br /> the Commission can proceed with the understanding the plan will have to <br /> designate this as rawer front. The Commission could close pending receipt of <br /> guidance from DEP. They are willimg to submit to the lawn policy. <br /> Public comments: Alan Bath stated he had not heard anyone mention that <br /> this is a nesting area for the Piping Plover. <br /> Mx. Mayes stated it is not in the habitat. Mr. Sherman agreed and advised <br /> Piping Plovers feed in the rack line. <br /> Mr. Hayes advised they are going to put a single family home in the footprint <br /> of disturbance. They have approval from the Board of Health for a Fast <br /> system. A 10 00' lawn is shown on the plan. The old footprint vs new is <br /> shown. <br /> VOTE: Motion made and seconded to close pending DEP number, Board of <br /> Health approval, resolution of the fee ano olies and wait for guid- <br /> ance on the Rivers .Act and showing river front on the plan. <br /> Unanimous Vote. <br />
