Mr.Hanks stated hopefully by the May Town Meeting,we may have an official reaction from the <br /> Conservation Commission. Mr. Baker said that right now the view from the outside is that the waterways <br /> Commission hasn't even asked the Conservation Commission. Mr. Hanks agreed. <br /> Mr. Daly asked if we submitted an article for the May Town sheeting warrant. Mar. Hanks said there <br /> should be an article in the warrant unless during the course of discussion,the Selectmen pull it. <br /> Mr. Baker is hoping to go to the Selectmen's meeting and ask them to re-authorize the article that had the <br /> $85,000 that is now$653000, Mr. Baker pointcd out there were two articles that passed in October of 196 <br /> 1996, They both die on October 6, 1999. if we don't have a replacement article passed by Town Meeting, <br /> we have nothing. Mr. Hanks added unless we've encumbered the money. Mr. Baker stated he would feel <br /> more comfortable if he went to the Board of Selectmen and asked therm to re-authorize whatever is left of <br /> the$85,000, <br /> REVIEW AND ACCEPTANCE of MINUTES: <br /> MOTION was made to accept the minutes of February 2} 1999 and was voted unanimously. <br /> OLID BUSINESS: <br /> 1. Harbormaster Report--No report, <br /> 2. Shellfish Constable Report—No report. <br /> 3. Committee Rppgrts <br /> Freslx water—Mr, Taylor <br /> Mr. Taylor reported they had a Mashpee—wakeby Lakc Management Committee meeting. Mr. <br /> Harks carne to the meeting. He and Mr. Taylor went over some of the regulations. Things are Corning <br /> along well. <br /> Mir. Hanks added that he explained to there that only the State can promulgate rules for great <br /> ponds. Mr.Hams said he made another pass of the draft regulations we have for use of the waterways <br /> and provided it to the Cottee. He stated that he later re-read the letter from the Town.Counsel <br /> pertaining to the draft by-laws that we sent hire. He noticed they objected to our Section 170-3 — <br /> Penaltics. The other part was when Mr.Hanks requested the legal opinion, he had a question on speed. <br /> He had questioned whethcr Scction 170-4(a)is legal}which has to do with bours of operation. The <br /> answer was this by-law mai'establish such a speed for all waterways. General Law Chapter 90(b)restricts <br /> the State's regulations of speed to freshwater ponds less than Soo acres in size. The Town}s by-law may <br /> adept a more stringent standard without being inconsistent with the statute. Mr.Hanks said he would talk <br /> with Mr.Ellis about this where he gets back from vacation. <br /> Mashpee_watershed Committee—Mr. Hanks <br /> Mr.Hanks reported it dict not meet because there was no quorum. <br /> New abu-ypnilrrten Prat Mar, Hanks <br /> Mr.Hanks said they are still working on permits. He stated that the County dredge is operating <br /> in Popponesset Bay, Mr.Daly reported they are still dredging it and they are dumping it right at the <br /> bottom of wading Place Road. <br /> 2 <br />
