3 April 1997 <br /> Page 5. <br /> Jim Cotes, representing Rock Landing Association and himself, as abutters, <br /> asked if the structure, or building, would have to have been on the site as of <br /> 1977? Mr. Sherman stated August 10, 1978. Mr. Collins asked if there had to <br /> be a structure there on that date? If it had been prior to that date and it had <br /> been removed or taken down, what then? <br /> Mr. Sherman stated that was ars interesting question. if there wasn't a <br /> structure there as of August 10, 1978, it had to be there prior to that date. <br /> Mr. Coffins stated when the new house was built and the guest house, the old <br /> structure was then taken down and there would have been a permit pulled to <br /> tear it down. Mr. Sherman stated there should have been a permit, but there <br /> had to be a habitable dwelling there as of August 10, 1978. <br /> Betsy Henning asked if it would have to have been in the same footprint on <br /> the lot? Mr. Sherman stated it would have to have been on the lot. She <br /> stated on the lot, not necessarily in the footprint. He stated it would not <br /> matter. <br /> VOTE: Motion made and seconded to continue the hearing to 1 May 1997 <br /> at 7:30 p.m. at the request of the applicant. Unanimous Vote. <br /> CONTINUED TO 1 MAY 1997 AT :30 F.M. <br /> :00 PAUL ON to amend the Order of Conditions for SE 3-1510 to <br /> permit the use of a room over the garage as a sewing room at 136 Captain's <br /> Romer. <br /> Mr. Sherman stated he recalculated the nitrogen loading and it is still less <br /> with a denitrifying system, even of there was one more bedroom. He <br /> requested a plan with the layout. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to accept the amendment as proposed <br /> upon receipt of a floor plan. Unanimous Vote. <br /> AMENDMENT ACCEPTED. <br /> 8:10 MYLES HUNTINGTON for an amended Order of Conditions for SE <br /> 3-1429 to include an additional lawn area at 87 Bayshore Drive. <br />
