3 April 1997 Page 5. Jim Cotes, representing Rock Landing Association and himself, as abutters, asked if the structure, or building, would have to have been on the site as of 1977? Mr. Sherman stated August 10, 1978. Mr. Collins asked if there had to be a structure there on that date? If it had been prior to that date and it had been removed or taken down, what then? Mr. Sherman stated that was ars interesting question. if there wasn't a structure there as of August 10, 1978, it had to be there prior to that date. Mr. Coffins stated when the new house was built and the guest house, the old structure was then taken down and there would have been a permit pulled to tear it down. Mr. Sherman stated there should have been a permit, but there had to be a habitable dwelling there as of August 10, 1978. Betsy Henning asked if it would have to have been in the same footprint on the lot? Mr. Sherman stated it would have to have been on the lot. She stated on the lot, not necessarily in the footprint. He stated it would not matter. VOTE: Motion made and seconded to continue the hearing to 1 May 1997 at 7:30 p.m. at the request of the applicant. Unanimous Vote. CONTINUED TO 1 MAY 1997 AT :30 F.M. :00 PAUL ON to amend the Order of Conditions for SE 3-1510 to permit the use of a room over the garage as a sewing room at 136 Captain's Romer. Mr. Sherman stated he recalculated the nitrogen loading and it is still less with a denitrifying system, even of there was one more bedroom. He requested a plan with the layout. Public comment: none. VOTE: Motion made and seconded to accept the amendment as proposed upon receipt of a floor plan. Unanimous Vote. AMENDMENT ACCEPTED. 8:10 MYLES HUNTINGTON for an amended Order of Conditions for SE 3-1429 to include an additional lawn area at 87 Bayshore Drive.
