29 May 1997 <br /> Page 12. <br /> MICHAEL VIKING for a Determination of Applicability on proposed <br /> beach nourishment at 69 James Circle. <br /> fir. Sherman advised they had a plan prepared by Sanford Associates and <br /> After-the-fact fees paid. A $100 fine was issued. A. violation notice will be <br /> sent because they have added an extension to the dock. They have Chapter <br /> 1 but will have to Me with us. <br /> Mr. Rosenberg suggested accepting a letter from. Mr. Vining because it i <br /> temporary. <br /> Mr. Sherman stated one of this previous violations included the dock which <br /> was withdrawn. <br /> Public comments: none. <br /> VOTE: Motion made and seconded to find a negative determination of this <br /> application and notify Mr. Vining he has to ale for the dock. <br /> Unanimous Vote. <br /> NEGATIVE DETERMINATION, <br /> 10:00 THE KEENE MASHPEE REALTY TRUST for a Determination of <br /> Applicability on a request to replace sand eroded from an existing beach at 57 <br /> James Circle. <br /> Mar. Sherman advised Mr. Keene's plan is not adequate and he also has a dock <br /> extension. 'There is an eisting violation and they have never clone the <br /> revegetation asked. <br /> Mr. Rosenberg suggested a positive determination. <br /> Mr. Sherman stated it is all buffer zone. They are putting sand in the water <br /> but it is not within a resource area so it could not be a positive determination. <br /> Public comments: none. <br /> VOTE: Motion Ornade and seconded to end a positive deternmination, unless <br /> within to days he has fled a plan that includes planting that i <br /> satisfactory to the Agent. Unanimous Vote. <br /> POSITIVE DETERMINATION PENDINGE <br />
