September 1997 <br /> Page 3. <br /> :50 LEONARD FLORENCE to amend the Order of Conditions for SE 43- <br /> 1376 to request placement of a 5' high steel fence along the property line at 73 <br /> Triton Way. Norman Hayes presenting, Abutter notice receipts were <br /> provided. An as-built plan was reviewed with the fence shown. it was agreed <br /> that the fence wifl he replaced in find on the hank. A split rail fence. A fence <br /> that was permitted will be removed. They are asking for the fence that comes <br /> down to the top of the coastal hank to where it intersects with the esting <br /> fence and then along to marry up with the fence already in. They would like <br /> o reserve the right to put in a black wrought iron fence up to 39 inches high. <br /> Mr. Rosenberg stated that was not in the notice, that says a 5' steel fence <br /> along the property line. Mr. Hayes said instead of putting a 5" high steel <br /> fence, they want to reduce that. <br /> Mr. Sherman stated the fence can be approved but if he wants to go less there <br /> is no problem with that. One other issue, comments were received from an <br /> anonymous person that there are other things there not in compliance so <br /> before the on-site, he asked Mr. Hayes to look around and let him know if <br /> there is something. <br /> Mr. Hayes stated there may he things he is net aware of. He is going on-site <br /> tornorrow and will report hack. Only issue he knows r is not in compliance is <br /> the wall has collapsed and bank is slumping. He will he addressing that with <br /> the Commission later. <br /> Public comments: none. <br /> VOTE: Motion made and seconded to accept the amendment. <br /> L nardmous Vote. <br /> AMENDMENT ACCEPTED, <br /> :00 KEVIN BYRNE, 17 Bayshore give, continued from 21 August 1997. <br /> The engineer, Chris Costa, had not staked the property and had requested a <br /> continuance. He did come in to the meeting and after_discussion, the hearing <br /> was dosed pending verification of stag. It was still not staked. <br /> No action was taker. <br /> 8:10 BOVA.RNICK, NOVAK FF & DUNCAN, Triton Way, continued from <br /> 21 August 1997. Bob Hamilton presenting. He and the Agent have consulted <br /> with Jim Mahala also. There is a memo of protocol incorporating shorefront <br /> owners. It was established last tirne why the project is needed. The <br />
