23 October 1937 <br /> Page 6. <br /> CONTINUED T '20 NOVEMBER 1997 AT 8:20 P,M. <br /> 8:00 LILLIAN BERN for construction of a swimming pool at 24 Tide Run. <br /> Michael Grotzke presented abutter notification receipts. The size of the pool <br /> is constrained by the property line. Mrs. Bern has Parkinson's disease and <br /> has undergone a lot of treatment and had brain surgery. It is further from the <br /> work limit than originaRy. They propose to move the fence to the edge of the <br /> pool apron. The pooh.is 16 x 26. They would agree to not use any chlorine. <br /> Mr. Sherman stated there are no issues under the Wetlands Act; the bylaw <br /> has a ' um setback <br /> Mr. Desrosiers asked for photos. <br /> Mr. Sherman questioned distances. 11r. Grotzke stated it is 35 feet to the <br /> edge of the fence. It is the only way to get a pool on the site.. <br /> Mr. Sherman stated the Commission will sometimes give in on the 50 foot <br /> setback, as they did for the house. It is still an encroachment into the buffer <br /> zone. The argument could be made for this if there is mitigation that is <br /> meaningful but he did not see any here. <br /> IIx. Careen stated there are other types of therapeutic pool construction, ever <br /> those that fit into basements. <br /> Mr. Desarosiers asked if it is a closed, heated, pool? It is not. He stated it <br /> would thea only be used for a couple of months each year. <br /> Mr. Rosenberg suggested they go to hoard of appeals and move it over <br /> another 10 feet. Mr. Grotzke stated it is not a special permit area. <br /> Mr. Sherman stated to go within the 50 feet, they have to prove the area in <br /> between has no wildlife habitat value. He recommended not passing on this <br /> until other alternatives have been explored. <br /> Mr. Grotzke would be willing to move the pool over and request a variance. <br /> It would net be-possible to put a pool in the basement as the house is only 26 <br /> feet wide. <br /> Mr. Sharpe asked what Mrs. Bern does the other months of the year?
