20 November 1937 <br /> Page 7. <br /> hydrologists and MEPA. They are revving forward with a monitoring program <br /> and some of the issues are resolved. Natural Heritage submitted some very <br /> significant comments. The water District is looking at them as the "Ant at <br /> the picnic". There will be a meeting in January up at MEPA where there will <br /> be pressure.to accept a monitoring program. The Commission may be jou" n*ng. <br /> Natural Heritage as another "Ant". <br /> Mr. Sherman asked Mr. wirsen for input. <br /> Mr. Green will accompany Mr. Sherman to the meeting. <br /> Bath; The adjudicatory decision has come down and was a victory. The <br /> appeal was thrown out. The bylaw fared well; he can only refile. Mr. <br /> Sherman would lie to ash for an informal meeting with ]SEP to ask what <br /> they consider VW s it is going to come up to the Commission again. <br /> Areas of Contamination: Areas the plumes are emanating from are <br /> targeted for clean-up. IPPA told the Agent there should be concern because <br /> some of the source areas are on Conservation land. He checked Assessors <br /> Maps and talked with Carl Gustafson , he does not believe they are. The SD-4 <br /> clean-up is in the middle of a wetland and although contaminated., it is a ` <br /> significant wildlife habitat. He recommended commenting to them Haat <br /> whatever they do in terms of cleaning it up, if any wetland is destroyed, they <br /> should rep cate it. <br /> Mr. Wirsen stated this wetland is probably over 5,000 s.f. Mr. Sherman <br /> thought it was. Mr. warsen advised It would thea hit Army Corps structure , <br /> they call for replication for anything over 5,000 s.f. <br /> The Chairman suggested a letter saying the Commission supports their plan <br /> and would like to receive other details and the Commission would be happy to <br /> advise them and help there to comply with the regulations. <br /> Lynch: The Agent questioned whether the Permit to access form signed by <br /> the legal owner, although the property is changing hands, can be considered <br /> the sane as consent. Mr. Rosenberg stated it is the same. <br /> Stone: The Agent advised he and. Norman Mayes have worked out the <br /> coastal bank, Mr. Hayes is asking to change one wetland flag. The Agent <br /> asked., once the flag is confirmed ed to be appropriate, can the permit be issued? <br /> VVhen he walked the line before, it was conservative. <br />
