19 February 1338 <br /> Page 15. <br /> Conservation Restriction: Model language was reviewed last meeting <br /> regarding the lot on Old Barnstable Road on the Child's River that Michael <br /> Grotzke advised they would be willing to place under a Conservation <br /> Restriction and do planting on to compensate for the small paring lot area <br /> they intend to put in next to Route 15 1. It was agreed in concept but <br /> language wffi have to be worked out for the restriction. This will have to be <br /> reviewed by Tom Fudala, Dave Bailey, Town Counsel and, possibly, Mar <br /> Robinson of compact of Conservation ' ousts, an expert in restriction <br /> language. Changes discussed at the last meeting have been made. <br /> Petition: Ed Raker is circulating a petition regarding , people on the <br /> lashpee River who feel dredging the river should be a priority to help the <br /> flushing. They are requesting that all dredging within Popponesset Bay be <br /> prohibited until remedial measures have been taken for the Mashpee and <br /> S n uit livers. This will be a political hot potato. Petition circulated for <br /> information only. <br /> Rand BankProposal: Hearings are being held on 5 March, same night as <br /> the Commission is meeting. Nir. Sherman suggested a letter to the <br /> newspapers that many people who were unwilling to support the previous <br /> proposal should be in favor of this equitable Funding. <br /> Release Forms: Two forms, procedural matters, were sent to Town Counsel <br /> for an opinion. One is a waiver re who is sitting on the hearings. It is a <br /> problem when there are multiple continuances. Under .the Act it is not a <br /> problem. <br /> Concerning Mrs. Fulton, the hearing should be closed and a denial issued <br /> within 21 days. The Agent has written up language. <br /> The forms proposed were reviewed. Nr. Sherman warts to be sure they do <br /> not conflict with some state statute. <br /> Quail Hollow: The owner of the legal dock was noted they have to file for <br /> the next hearing. It has been removed and the matter is on hold. If they <br /> agree to not put it back in, the matter is closed. <br /> Poorer: At the last hearing, there was discussion about misinterpreting the <br /> Riverfront regs. According to Lenore shite, we did have the correct <br /> interpretation. The applicant will have to prove they cannot do it (per41)) <br /> before going to 4D3. <br />
