It was thought the Town owned the land but some group has established some sort of ownership even though not iron clad. They are holding the Town hostage threatening to get a building permit and build immediately. What they would really like is money. George's scheme is that we would take it by eminent domain to stop them from going further. Orenda. and CCCC would up-front the money. He would like the Commission to co t, some time after duly 1, to repay Orenda $40,000 and they would then sell it back to the town. The appraised value is $300,000. Mr. Rosenberg agreed it would be a disaster to allow a house in there. VOTE: Motion made and seconded to reserve up to $40,000, if necessary to to contribute to the acquisition of the 6 acre parcel on Great Oak Road, from the Conservation Land Maintenance and Improvement Account. Unardmous Vote. Membership: Ralph Shaw and John Johansen agreed to request reappointment. Howes: This application for a clod and there were questions about the land it would touch or go upon. VOTE: Motion made and seconded that in accordance with 310 CMR (5) (B) 3, when the applicant is ready to resume and has settled theprop- erty questions, the Commission will hold a hearing within 21 days; it will be necessary for the Applicant to renotify and readvertise. Unanimous Note. Werri : The Agent advised he has met with him and is optimistic there wifl be a resolution. A plan should be in next week. An enforcement order will be issued to carry out the plan. Conservation Restriction: Mr. Rosenberg stated he still has problems with the restriction for Old Barnstable Road. It was changed and now the work limit will have to go into the Conservation easement. The Town cannot enter on that land and use it, only to see what he is doing. The 'down is losing tax dollars.
