23 July 1998 <br /> Page 13. <br /> Turner Well: A draft order was written with rights reserved to fine tune it <br /> when the N.ICPA process unfolded, which it has. The Cape Cod Commission <br /> had some comments about monitoring especially. The Agent met the other <br /> day with Mario UiGxegorio and his associate and the Nater District. He <br /> spoke by phone with Gabrielle Belfit. They have agreed to follow' the <br /> recommendations for monitog. If the water level cannot rebound within <br /> eight hours to it's original height, pumping will stop. <br /> The monitoring plan will be for ten years, with sampling, every two. <br /> Vegetative changes de not usually show up within one year. <br /> Mr. Wollenhaupt asked if there was standing water in the wetland? Mr. <br /> Sherman stated yes, at certain times. With monitoring water levels, after a <br /> year the Commission would have the right to amend the order to make sure <br /> whatever is being done, the recovery is within that eight hour period. He <br /> will write up the Order of Conditions next week. <br /> New Seabury Dump Site: Mr. Wallenhaupt advised he was there 3-4 <br /> weeks ago. There were 12 test pits at a depth of 12' extending beyond the <br /> lateral depths shown. It appears the construction demolition extends a <br /> maximum of 12' into the coastal bank. They did not want to ruin any <br /> vegetation that is there. The small amount that is in there will be removed <br /> and the coastal bank replenished, replaced and replanted. He will update <br /> the Board as this proceeds. <br /> Warrick Enforcement:, The Agent advised Mr. Warrick is balking at the <br /> price. They have beefed up the original plan and the cost is about $8500. As <br /> a matter of due process, he has asked to came in for the next agenda to <br /> address the Commission. The Agent felt he should be heard, but should be <br /> told the Commission will go to court to resolve this, if necessary, if he is not <br /> willing- <br /> Mr. Rosenberg staffed he should be told the Commission is prepared to issue <br /> an order for an exact replacement of what was there before. He would be up <br /> to about $20 - $30,000. <br /> The Agent advised he isgoing to ask to reduce the number of plantings to <br /> save money. <br /> Lapierre; The Agent advised Mr. Lapierre is behind in plantings and has <br /> mowed the area since the first time. He recommended fining him and <br /> sending an enforcement order to either get with the program or go to court. <br />
