6 August 1998 <br /> Page 9. _ <br /> Ms Ball stated the footprint of the pool is smaller. Mr. Sherman stated they <br /> changed the material and he is concerned it is less porous. He wanted <br /> something, and the burden of proof is on them, to show there is not going to <br /> be an erasion problem. He asked how runoff from the pool apron would be <br /> mitigated? Ms Ball stated the french drains along the edge. It is shown on <br /> the blueprint. <br /> Near. Green Mated this would not work if not pitched to the outside. Ms Ball <br /> stated it is a 2% slope. Mr. Sherman- asked if they would mind if he and Mr. <br /> Green check this nut? He stated the planting plan is adequate. If there is a <br /> plan that everyone can agree on, he hopes Mr. Lynch will stick to it. <br /> Ranting to be done in the fall. <br /> Mr. Sherman suggested this plan be fleshed out as to what is existing and <br /> what will be planed and when. <br /> The Chair asked for a narrative. <br /> Mr. Sherman asked that the client be made aware this is not going to be a <br /> "wood chip environment" and that other natural materials will be allowed to <br /> come in. He asked Ms Ball to incorporate that into the narrative that <br /> between plantings other natural grasses and things from coming in. There is <br /> a standard order that says between plantings, natural, regrowth of <br /> herbaceous materials not be cut. ` <br /> Public comment: Atty. Stephen Snow, representing the abutters, the <br /> Wachtenheims, stated the discussions failed to mention the pool equipment. <br /> These are new additions that Mr. Lynch placed onto the property without <br /> seeking approval from the Comnu`ssion. He heard what Mr. Sherman said <br /> about the generator. He has been to the site and he thinks the generator is <br /> loud and can be heard from across the street. When he last left, he thought <br /> there was going to be a decibel check; it was his impression this was going to <br /> be done. He thinks it is unfair to the abutters that this particular property <br /> owner can do whatever he cares to do, clearly in violation of existing <br /> regulations, and then come back later to move to amend his Order of <br /> Conditions and get approval on what he should have come for in beginning. <br /> Mr. Sherman agreed these changes are very vexing and objectionable. <br /> However, if he comes back through a formal proceeding and the changes he <br /> proposes meet the performance standards of the Act and the Bylaw, the <br /> Commission has no recourse but to approve them, as disturbing as they may <br /> . be, in the way he did thing. <br />
