20 August 1998 <br /> Page 3. <br /> NEGATIVE PENDING. <br /> 7:20 HERBERT GLANZ for a Determination of Applicability on a request <br /> to repair and maintain in perpetuity an existing dock at 116 Fells Pond <br /> Road. Wayne Tavares presenting. <br /> Mr. Fitzsimmons asked if there were any objections to his sitting for this <br /> hearing as he is a neighbor. There were none. <br /> Mr. Tavares stated they have had a dock for many years but ice and high <br /> water have caused damage. It may be lifted up one step. Diane Boretos <br /> looked at the site. All work will be done by hand. Some of the steps going � <br /> down to the dock have ratted and may be replaced. <br /> Mr. Sherman asked if work was proposed on the existing cement patio? <br /> None was proposed. He stated steps to the deck were not part of the filing. <br /> He asked haw steep they are. Mr. Tavares stated there is 2-3 feet between <br /> each step. It is 1-5 going to the pond and there are 30 to 40 steps. <br /> Mr. Rosenberg asked if Chapter 91 is involved. Mr. Tavares stated it is not <br /> a great pond. <br /> Mr. Sherman stated there was just the question of whether the stairs could <br /> be replaced as they were not part of the notice. He would be satisfied if <br /> language was added that whenever repairs are done, the Commission will be <br /> notified and can add conditions. <br /> Mr. Fitzsimmons stated the problem is that the dock is so law that when it <br /> freezes in the winter, it raises the dock up. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to find negative. Unanimous Vote. <br /> NEGATIVE DETERMINATION. <br /> 7:25 MILTON GLASS for a Determination of Applicability on a request to <br /> permit after-the-fact construction/installation of wooden steps and landscape <br /> railroad ties at 30 Fells Pond Circle.
