20 August 1998 Page 3. NEGATIVE PENDING. 7:20 HERBERT GLANZ for a Determination of Applicability on a request to repair and maintain in perpetuity an existing dock at 116 Fells Pond Road. Wayne Tavares presenting. Mr. Fitzsimmons asked if there were any objections to his sitting for this hearing as he is a neighbor. There were none. Mr. Tavares stated they have had a dock for many years but ice and high water have caused damage. It may be lifted up one step. Diane Boretos looked at the site. All work will be done by hand. Some of the steps going � down to the dock have ratted and may be replaced. Mr. Sherman asked if work was proposed on the existing cement patio? None was proposed. He stated steps to the deck were not part of the filing. He asked haw steep they are. Mr. Tavares stated there is 2-3 feet between each step. It is 1-5 going to the pond and there are 30 to 40 steps. Mr. Rosenberg asked if Chapter 91 is involved. Mr. Tavares stated it is not a great pond. Mr. Sherman stated there was just the question of whether the stairs could be replaced as they were not part of the notice. He would be satisfied if language was added that whenever repairs are done, the Commission will be notified and can add conditions. Mr. Fitzsimmons stated the problem is that the dock is so law that when it freezes in the winter, it raises the dock up. Public comment: none. VOTE: Motion made and seconded to find negative.
