3 September 1995 <br /> Page 14. <br /> VOTE: Motion made and seconded to close subject to receipt of DEP and <br /> revised landscape plan. Unanimous vote. <br /> CLOSED PENDING, <br /> 9;20 TOWN OF MASHPEE to clear a ' wide path to a I5' 25' clearing <br /> with bench for vista viewing at River Road. <br /> Mr. Sherman advised he and Mr. Green walked the site to find the best place <br /> for citizens to have a view. The platform is not over the bank. Cutting will <br /> be overseen by he and Mr. Green. The only issue tonight is the first 200P <br /> under the Riverfront Act, only this portion. He spoke with DEP and <br /> although the Act and regulations would seem to preclude projects such as <br /> this, this was not their intent. The Act exempts private walkways but does <br /> not specifically mention pubic. It meets all the performance standards. <br /> Pubhc comment: Jinn Hanks, Chairman of the waterways Committee <br /> requested the Com sion not close on this hearing until they have had the <br /> opportunity to discuss using this area for dredge material disposal. and then <br /> to vegetate it afterwards to create wild fe habitat. They have not given a <br /> presentation yet and would like.a chance to do so. <br /> Mr. Sherman stated that area where they are planning to do this would not <br /> fall under the discussion tonight, it is only for 20 ' from the River is the <br /> juri <br />
