There is already disturbance M* the first 100 feet,. It is not exempt. He suggested a continuance. Mr. Sanicki stated Ms Mantel filed and received permission to upgrade the septic. She wants to rebuild ars old deck. They are not tang down any trees, Mr. Sherman asked if they had any pictures of the pre-est g deck; Some indication it existed is.needed and that the new deck is not larger than the old. Mr. Sanicki asked if pictures cannot be found, but an affidavit could be obtamned from a neighbor, would that be acceptable Mr. Sherman Mated if the Rivers Act does not apply, it is std within the Commission's 50' buffer zone and mitigative plantings are required. They would have to have at the edge of the water an area equal to the proposed deck. Mr. Rosenberg asked if this needs to be readvertlsed or have an amended request to rebuild an pre-eidsting deck?. Mr, Johansen asked if It should not be an N01 anyway? Mr. Sherman stated if a riverf ont area and not a pre-existing deck., the Commission would have to find positive.
