17 December 1998 <br /> Page 9. <br /> VOTE: Motion made and seconded to get an opinion from Town Counsel., <br /> in wming. Unanimous Vote. <br /> Mar. Sherman stated the Air Force is in a great hurry. It was made clear to <br /> then that from a technical review standpoint, it may not be possible to issue <br /> an order after one hearing, more information may be needed. <br /> The Chair asked if the Commission should hire some consultant? Mr. <br /> Sherman stated the Commission has the power to do so under the bylaw and <br /> may want a second opinion. It will have to be decided whether F2B has <br /> acceptable impacts or not. Steve Hurler of Fish & wile still has qualms. <br /> He made the point that they have to get an in-house resident on board, <br /> wildlife fisheries person, to look at this alb the way along. we have to fax one <br /> to hien, as soon as we get it. <br /> The Chair asked, under the Jacobs plan, who is going to be the operator of <br /> these ' 'ties? Mr. Sherman stated the Air Force. The Chair asked if there <br /> is some estimated time schedule by which time the bog will be cleared? They <br /> do not know; they are taping a minimum of five gears. <br /> Mr. Johansen advised they grant to get the bog clean by the planting of next <br /> year so that by harvest time of 2001, it will be the first product that goes out. <br /> Ocean Spray has a one-year clean, no detect, berries and water. <br /> Mr. Sherman stated probably there will never be a commercial crop from that <br /> bog again. <br /> The Chair stated they are going to agree to give us $200,000 for 98 and 99, <br /> =. what about after that? Mr. Sherman stated it is not certain. They are going <br /> . 5 <br /> { to do their best to get it cleaned up and then say we are on our own, <br /> Mr. Johansen stated if we sit back too long on some of these things, they are <br /> going to come back and say we are breac'hing the agreement. <br /> Mr. Sherman distributed copies of the agreement given to him this evening <br /> by Mr. S ymoniak. <br /> Reqs. Hearing: The Agent advised Diana did some research and learned <br /> the fee for RDA's does not cover advertising. He proposed raising it t $3o. <br /> He suggested also waking minor changes.in the burden of proof segs for tidal <br /> rivers out of the knowledge gained in the Powers case. It was agreed the <br /> public hearing will be held on 7 January 1999. <br />
