r <br /> Mr. Bates stated that his Board has a meeting on Saturday. He asked if the ommission's vote could be <br /> postponed until the next meeting o that his Board can review the application. <br /> Mr. Shernm said that he personally would have no objection to that. He did say, however,that no matter <br /> what Mr. Bates"Board said,the Commission would still have no justification of denying it. <br /> Mr. Bates said he understood thcy really had no legality but any consideration the Commission could give <br /> there to better understand what the application is all abort would be appreciated. <br /> Jeanmie Landry believes what Mr.Ellis is doing is trying to ask the Town to take over the restrictions and <br /> enforcements ofthis parcel. Mr. Green explained that we cannot take over the enforcement of State <br /> property. Ms. Landry said that the Mate is asking the Town. That was what they were discussing with Mr. <br /> Ellis. They did not know that he has gone this far. She believes it would be reasonablc to wait until Mr. <br /> Ellis cones back. <br /> Chet Mahoney,President of Popponesset Beach Association, said that his Association is an abutter. As far <br /> as the Commission meeting,he wondered if they should have been notified. <br /> Mr. Sherman answered no. He said the Request for Dctemuination of Applicability does not require legal <br /> notices in newspaper avis. <br /> VOTE: Motion Ornade and seconded to continue the hearing until March 18, 1999 at 7:55 p.m. Unanimous <br /> Vote <br /> HEARING CONTINUED. <br /> 8:35 GEORGE SI OGST OM for Determination of Applicability on.the placement of 3"-4' fence as <br /> shown on plan at 157 Timberland give. <br /> Mr. Sherman stated the fence would go no further towards Santuit Pend then an existing wall. It will <br /> actually sit on top of the wall. <br /> The Chair called for public comment;there was none. <br /> VOTE: Motion made and seconded to find negative.,Unanimous Vote. <br /> NEGATIVE DETERMINATION. <br /> 8:45 ROBERT ERKE to amend the Order of Conditions for SE 4 -1746 to allow construction of a patio <br /> at the rear of 16 Fells Pond Road. <br /> Mr. Sherman explained the patio is within the existing work limit of a previously approved house, so he <br /> cues not see what the issue is. <br /> The Chair called for public comment;there was none. <br /> VOTE: Motion made and seconded to approve the amendment. Unanimous Vote. <br /> A11ENDMTNT APPROVED. <br /> OLD BUSINESS <br /> COMMENTS TO 1 IEA& CCC REGARDING HOLLAND HILLS: Mr. Sherman advised that the <br /> j final comments are due March 1 , 1999. Mr. Sherman recommended that the Comraission send a lettcr to <br /> the Cape.Cod Comrnission and MEPA stating the recommendations on the handout he passed around. In <br /> essence,vire would be mhTo6ag the comments of the Cape Cod Commission staff. <br /> 10 <br />
