23 September 1339 <br /> Page 4. <br /> Mr. Sherman cited the meed for numbered station flags for the resources. <br /> Mr. Grotzke stated the plan was marked up last meeting. This was approved <br /> before. <br /> Public comment: none. <br /> VOTE: lotion made and seconded to close pending Board of Appeals and <br /> revision on the plan with stations and flags and to allow the Agent <br /> to check that this is the same plan before Board of Appeals. <br /> Unanimous Vote. <br /> CLOSED PENDING. <br /> 7:35 JOSEPH TARABELLI, 136 Fells Pond Road, continued from 2 <br /> August 1999. .A letter was read by the Chair requesting a continuance. It <br /> ill.be the last such request. Att . Creeden was present and asked for a six <br /> weeks s continuance. <br /> HEARING CONTINUED TO 4 NOVEMBER 1939 AT 7:30 P,M.0 <br /> 7:40 NEW S A URY PROPERTIES LLC, 188 shore Drive, continued <br /> from 26 August 1339. Michael Grotzke presenting. Mr. tarot l e stated there <br /> is nothing new. They submitted additional information prior to the hearing, <br /> the location of all resource areas and Deans Pond across the street shown on <br /> the plan. <br /> Ms oretos advised the resources associated with the dune and BVW were <br /> delineated correctly. It was noted the delineation of the dune was by Michael <br /> Pall. Mr. Sherman had no problem with flagging. <br /> 4 <br /> Public comment: David Foley stated the applicant, under Regulation 17-12, <br /> has the burden of proof they will not degrade the beach. There is no evidence <br /> submitted to carry that burden of proof. <br /> Ms Boretos stated what is currently going on is a lowering of the elevation of <br /> the dune because of the pedestrian foot traffic, what is being proposed will <br /> enhance the ability of that dune to provide storm damage and flood control. <br /> Mr. Foley asked if there is information from the applicant to support that? <br /> Ms Boretos stated her professional opinion is that this is not necessary <br /> because plants will trap sand and the dune will be rebuilding. Mr. Foley <br /> stated foot traffic will degrade the dune wherever it goes. <br />
