They submitted additional information prior to the hearing, the location of all resource areas and Deans Pond across the street shown on the plan. Ms oretos advised the resources associated with the dune and BVW were delineated correctly. It was noted the delineation of the dune was by Michael Pall. Mr. Sherman had no problem with flagging. 4 Public comment: David Foley stated the applicant, under Regulation 17-12, has the burden of proof they will not degrade the beach. There is no evidence submitted to carry that burden of proof. Ms Boretos stated what is currently going on is a lowering of the elevation of the dune because of the pedestrian foot traffic, what is being proposed will enhance the ability of that dune to provide storm damage and flood control. Mr. Foley asked if there is information from the applicant to support that? Ms Boretos stated her professional opinion is that this is not necessary because plants will trap sand and the dune will be rebuilding. Mr. Foley stated foot traffic will degrade the dune wherever it goes.
