9 September 1999
Page 1 .
Vehicles on Beach; over the past week there were reports of a vehicle on
the beach. This is prohibited under the Bylaw. If this was followed exactly,
it would prohibit beach nourishment. There should be a revision at Town
Meeting.
Southport: .An invitation has been received for the opening celebration for
Southport for cocktails, dinner and dancing.
M. Greenberg: Request received re Cotuit Golf Course application. The
Agent suggested writing back to state what the law says. The first
hearing is advertised and the abutters notified. Thereafter, continuances
are announced at the hearings and interested parties should take note.
The Commission has neither the staff nor the funds to send out special
notices.
VOTE; Motion made and seconded to write to M. Greenberg as stated by the
Agent. Unanimous vote.
Chane in Bedrooms: If someone has a two bedroom house and will not
increase the number of bedrooms., the Commission has not required
denitrifying. The Agent advised, after talking ith the Building Inspector,
he is suggesting if the number of bedrooms is in question, go back to the
original permit and go by that number.
Mr. Rosenberg stated the Commission should insist that on any such
application that whoever is applying certify as to what is in the house now.
Mr. Sherman stated they say what is in the house now is not an increase.
The Chair asked how the Board of Health is involved` Mr. Sherman stated
the number of bedrooms being proposed now is more than the septic system
will allow. Thinking in terms of the nutrient loading regulation; if the
capacity is equal to the number of bedrooms, it is still an increase to
nitrogen. The Board of Health is only looking t flowage. It does not matter
what they say they had. He feels they should use what is a benchmark on
the permit. The Commission agreed.
VOTE: Motion made and seconded to install that if the increase is more
than on the original building permit, a denitrifying system is
required. Unanimous vote.
