MASH.PEE CONSERVATION COMMISSION <br /> Minus of 7 October 1999 <br /> Commissioners.present: John Fitzsimmons, Elliot Rosenberg, John <br /> Johansen, George Green Jr. <br /> The Chair called the meeting'to order at :10 p.m, upon the arrival of Mr. <br /> Green. <br /> PUBLIC COMMENT: Peggy Fantozzi came before the Board regarding <br /> Willo bend. A hearing is scheduled on Cape Cod Commission Jurisdictional <br /> Determination for a IPI on October 13. They are asking Conservation to <br /> agree to a postponement of the decision or withdrawal. Willowbend has been <br /> participating with Cape Cod Commission staff on that issue. The discussions <br /> ended in agreement to pursue a development agreement option. The glitch is <br /> that if the public hearing results in a vote that acknowledges the project as a <br /> DRI then they cannot continue in the negotiations for a development <br /> agreement. That is on-going and some time is necessary for firming up <br /> development agreement with the Cape Cod Commission, as well as the <br /> Mashpee Boards. By mid-November the agreement should be well-defined. <br /> They will streamline the process for the Town as well as the Cape Cod <br /> Commission if they can do that. <br /> Mr. Rosenberg asked if under those circumstances they will need revised <br /> plans? Ms Fantozzi stated it puts everything wide open and on the table. <br /> Mr. Rosenberg stated with revised plans they will have to readvertise. Ms <br /> Fantozzi states there is nothing in front of Conservation that relates to this. <br /> The development agreement being negotiated with Cape Cod Commission in <br /> concert with town boards in Ma tepee would be for the renovation project that <br /> is presently before the Planning Board which includes a proposal for the <br /> additional nine holes.- It would also address -any subsequent development in <br /> terms of within those property bounds. It would set stipulations that would <br /> be pre-agreed to. <br /> Mr. Sherman asked Ms Fantozzi if she had a new- letter? She has a draft <br /> that will be on his desk tomorrow. 'It says what she has stated. The first <br /> part is informational. The second part states that if unable to male progress <br /> by the middle part of November, as determined by the Commission staff in <br /> consultation with 1lashpee, then Willobend will provide the Cape Cod <br /> Commission with detailed information for the j urisdictional determination. <br /> Mr. Sherman would not be averse to a temporary withdrawal until mid- <br /> November to give them an opportunity work it out, but to reserve the right to <br />
