MASHPEE CONSERVATION COMMISSION <br /> MINUTES OF 4 NOVEMBER 1999 <br /> Com,missi n rs Present: John Fitzsimmons, Elliot Rosenberg, John <br /> Johansen, George Green Jr., Ralph shave, <br /> Greg Wirsen. <br /> The Chair called the meeting to order at 6:55 p.m. with a quorum present. <br /> 6:55 PUBLIC COMMENT: The Agent advised Carol Moore was present <br /> and had sent a letter to the Commission to stated she wanted to get involved <br /> in something for the Town and is interested in the environment. <br /> Mrs. Moore advised she is a 'title Examiner, works for herself and is flexible <br /> with daytime hours. F <br /> The Chair thanked her for coming in, <br /> Tack McElhaney stated they had a good site walk. Mr. Green was there. Mr. <br /> McElhaney offered to any questions-people may have. The Planning Board is <br /> supporting the idea of development. It is a much better goad to go. <br /> Mr. Sherman advised the Commission, at the last meeting, empowered him <br /> to meet with the Cape Cod Commission. They had temporarily withdrawn <br /> the request. After hearing all the issues, they thought they should reinstate <br /> the Jurisdictional Review. with that and the SII, there would be the <br /> process of appeal. Certain issues needed clarification, such as who falls <br /> under the jurisdiction. <br /> Mr. Rosenberg asked if the development agreement could be entered into <br /> without the participation of the Conservation Commission. r. Me lhane <br /> y <br /> advised the Planning Board negotiates the agreem' ent, they would include <br /> the Commission. In terms of the development agreement, it gets all of the <br /> stakeholders around one table to work out all the issues. They are proposing <br /> to service Cotuit Ray Condos off thein plant, at no cost. 70 acres on <br /> Meetinghouse Road will be dedicated open space. They would do more than <br /> they could be asked to do under a DRI. <br /> Mr. Sherman stated those could also be required under a DRI. <br /> . <br /> The Chair stated, addressing the Jurisdictional Determination, the <br /> Commission should go ahead with this. He called for a motion. <br /> Mr. McElhaney stated there would be an appeal. <br />
