i <br /> 2 December 1999 <br /> Page 6. <br /> regardless of whether or not any portion of this vernal pool buffer zone <br /> comprises a resource area as described in section 1+72-2. so it is 100' from the <br /> vernal pool itself that is considered part ofthe vernal pool habitat. <br /> Mr. schall stated that is not the way he is interpreting it. <br /> The Chair stated it is very clear. He asked if the Commission imposes this <br /> 100' regime, it would effectively sterilize this let? Mr. Sherman stated it <br /> would make it very difficult to have........The Chair statO d this is only 6 o' so <br /> another o' would effectively sterilize the lot. Mr. Sherman stated in terms <br /> of the 100' and its importance to the vernal pool, yes. <br /> Public comment: <br /> Shirley setian, an abutter, stated she is concerned about privacy if the house <br /> has to be moved for Conservation issues. she asked if a sterile lot cannot be <br /> built upon <br /> The Chair stated he was thinking if the house has to be moved to provide <br /> 100' from the edge of the inland wetlands, then it will not leave very much <br /> room for a house to be built. It would effectively sterilize the utility of the lot. <br /> Mr. Sherman stated there are conditions which make it-impossible to build a <br /> house. In other cases, the Commission has gone as low as 85'. The <br /> Commission has never gone below 85' and he would not recommend that they <br /> ever do. <br /> Larry Agnitti, his family owns the lot, stated when they bought the let it was <br /> twelve years ago and restrictions were not around then. It was a buildable <br /> lot back then. with this lot and the way laws do affect this lot, it does <br /> become not a buildable lot if this -is imposed. It was an accepted lot at one <br /> time; he thought that should be taken into consideration. <br /> r <br /> The Chair stated his situation is not uncommon. <br /> Armando Agnitti asked if he can get some of the money back from the taxes <br /> he paid for twelve years? He stated he has been paying $12.00 a year taxes <br /> on that lot. The Chair stated he would have to take that up with the Town <br /> and if-Mr. Agnitti did not life what took place here tonight, he can always <br /> appeal. <br />
