Carol Moore reported there is nothing on file at the <br /> Registry of Deeds. <br /> Mr. Sherman stated the Assessor' s Records continue to show <br /> ownership in the name of Mr. Codair; there is currently a <br /> Purchase and Sales Agreement consummated by a court appointed <br /> attorney for the purpose of adjudicating this situation/dispose <br /> of the property. <br /> Mr. Sherman informed the Commission that Town Counsel <br /> advised avoiding a discussion of ownership; and to merely <br /> establish the fact that the contention is the Purchase and Sale <br /> Agreement on the property consummated by a court appointed <br /> attorney. <br /> Mr. Sherman noted however that the list of abutters, as <br /> provided by the Assessor' s Office, shows Larry Codair, 55 <br /> Robinson Street, Lynn, Massachusetts, owner of 114-23A being the <br /> subject parcel, was on the abutter' s list provided to Mr. Lolito. <br /> He asked whether or not that individual had been notified by <br /> certified mail . <br /> Megan Raymond responded, "That person. . .as it was the <br /> subject parcel, that person was not notified. " <br /> Mr. Sherman informed the Commission of Town Counsel ' s <br /> determination that the individual in question should have been <br /> notified by certified mail . Had he been properly notified and <br /> failed to object in person or by fax, the Commission would be <br /> free to proceed in this matter. He reiterated that this <br /> individual is listed on the abutter' s list, as provided by the <br /> Assessor' s Office, and that it was assumed he had been properly <br /> notified. <br /> Mr. Sherman determined the prudent thing to do would be to <br /> continue this matter. <br /> Mr. Lolito concurred this matter should be continued for <br /> two weeks time, stating he would notify this individual by <br /> certified mail on April 14th. <br /> There being no public comment or further Commission <br /> discussion, the Chairman entertained a motion. <br /> MOTION: Ralph Shaw made a Motion to continue this matter to <br /> April 27th at 8:25 p.m. at the request of the Applicant; which <br /> Motion was seconded by Carol Moore and so voted unanimously. <br /> 8: 05 Alexander Levine, 1 Waterline Drive North-A continuance <br /> from March 30th, Notice of Intent. <br /> Mr. Sherman advised this matter is to be further continued <br /> as requested by Arlene Wilson. Neither the Commission nor Zoning <br /> -17- <br />
