Applicant of the necessity to obtain permission from the legal <br /> owners of said property. <br /> Mr. Collins appeared to be satisfied with the explanation <br /> of events as provided by the Conservation Agent and Assistant <br /> Conservation Agent. <br /> The Chairman entertained a motion be made in this matter. <br /> MOTION: Ralph Shaw made a Motion for approval of a Negative <br /> Determination; which Motion was seconded by Carol Moore and so <br /> voted unanimously. <br /> 8 : 15 New Seabury Property, 138 Fairway Lane-A continuance <br /> from March 30th. <br /> The Chairman recognized John Vaccaro, Earth Tech and Kevin <br /> Klien. Mr. Vaccaro explained they had appeared before the <br /> Commission in March to present the project, the New Seabury golf <br /> maintenance facility and wastewater treatment plant. <br /> The Board of Health has approved the project with comments <br /> to the Conservation Commission. <br /> Mr. Sherman acknowledged the project may have been approved, <br /> however the Commission is not yet in receipt of the comments. He <br /> agreed to verify the status with the Board of Health on April <br /> 14th. <br /> Diane Boretos reported that she had made an inspection to <br /> the site as it relates to vernal pools and found that there are <br /> some vernal pool species in existence. <br /> Mr. Vaccaro stated he has been monitoring the site for <br /> approximately one month. He stated there are spring peepers. <br /> Ms. Boretos noted the existing draught conditions, stating <br /> the area may be a vernal pool, and that the wood frogs are not <br /> chorusing, or have chorused early and are not currently being <br /> heard. <br /> Mr. Vaccaro stated the proposed project would not diminish <br /> the amount of water in the pool . <br /> Ms. Boretos stated she is concerned with the fact the <br /> project will be adding water to the area. <br /> Mr. Vaccaro stated the existing quality of the water would <br /> be improved by the fact that the existing road drainage would be <br /> intercepted and treated. He further stated his confidence that <br /> potential vernal pool habitat will continue to be provided. <br /> George Green inquired as to the responsibility of <br /> -19- <br />
