MASHPEE CONSERVATION COMMISSION <br /> Minutes of 8 June 2000 <br /> t <br /> Commissioners present: John J. Fitzsimmons, Elliot Rosenberg, John <br /> Johansen, Ralph shave, Carol Moore. <br /> The Chair called the meeting to order at 6:55 p.m. and called for public <br /> comment. No one came forward. <br /> 7:00 L. CLARE MILL to amend the order of Conditions for SE 3-1654 to <br /> allow the property owner to maintain a 10' x o' wooden deck attached to the <br /> northeasterly side of the dwelling together with mitigative plantings at 50 <br /> Popponesset Island Road. Alexander Joyce, Atty., was present for Mr. Hill. <br /> He advised the Board that Mr. Hill has resided at this address for 50 years. <br /> Back in 1998, an amended-order requested through an engineering firm to <br /> erect a Io# x 40" deep and other landscaping measures and to put filter fabric <br /> behind the retaining wall. During the hearing process the deck was erected <br /> and Mr. Hill was not aware the contractor had clone it without a valid permit. <br /> The applicant came bat and the Commission denied the deck but allowed <br /> what is shorn in yellow on the landscape plan. An appeal was filed to <br /> Superior Court and the Nudge remanded it for further review. A mitigation <br /> plan was arrived at. An expanded buffer seaward of the deck is shown on the <br /> plan in green. They are seeking to remove 125 s.f. of lawn. Area to be <br /> removed is shown. <br /> Paul Hess, Landscape Architect advised they are taking all plantings off the <br /> list of species in the regulations. They are trying to leave natural corridor <br /> for wildlife. <br /> Mr. Sherman stated the plan is consistent with past policy for mitigative <br /> plantings. He asked if they would be willing to do this in the very ear future? <br /> They will try to do so. Mr. Sherman suggested if not done by late June, it <br /> might be best left to Fall. Atty. Joyce will notify his client. <br /> The Chair called for comments. <br /> Mr. Rosenberg asked if the area between the del and the lawn they are <br /> removing is presently lawn? Mr. Sherman stated it is pre-existing. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to adept the amendment as proposed. <br /> Unanimous Vote. <br />
