I
June 2000
Page 4.
it is proposed to pre-treat run-off. They did boxings in two locations. They
propose to further enhance water duality and to come up with a restriction t
not allow any work in the area in order to provide habitat for the species.
They will put a restriction on part of the lot and also on another lot owned by
the applicant. Species most successfully are utilizing upland.. The back
portion is out of the Commission's jurisdiction. One last observation Mr.
Llito made is that the vernal pool occurs within the wetland system but
confined to a smaller portion. He has flagged the edge of the habitat within
the standing water of the vernal pool. From flags 1 and 2, it is 14' from the
wetland to the edge of the vernal pool.
Mr. Sherman was not prepared to sign-off. If going to buy into this approach,
adjustments would have to be made in the regulations. It may be best to
withdraw this application. The Bylaw would not allow for this. There is
simple language for changing the rgs and a matter of a month to accomplish.
Mr. Lelito asked to continue it to discuss it with his client and to provide a
letter withdrawing this.
VOTE: Motion made and seconded to continue the bearing to 6 July 2000
at 7:10 p.m. at the request of the applicant. Unanimous vote,
HEARING CONTINUED.
7:40 DAVID ANDERSON for a Determination f Applicability on thinning
and pruning of trees, tree removal and replanting with shrubs, installation of
a landscape timber retainer at 33 Fiddler Crab Lane. Jeffrey van Pelt of
Davey Tree was present. They will remove an oak tree and install four new
shrubs.
Mr. Sherman stated that is acceptable and the shrubs will be agreed upon.
Pruning to be done after November. Plant material to be put in immediately.
Public comment: none.
VOTE: Motion made and seconded to find negative subject to agreement
n the plantings.
NEGA IVE PENDING.
I
