June 2000
Page 1 ,
Mr. Rosenberg stated that has nothing to do with this because it is obvious
from looking at the plan that it is possible to build on that lot and to stay
within the line 3 ' from the coastal bank. That is the only issue here.
Mr. Brabants stated it is not impossible to build, he could build a house that
would suit somebody else, but again, he bought the land, he pars the taxes,
he happens to Ter with both him and Ms Boretos on the fact that ghat he is
forced to do on his own land......
Mr. Rosenberg stated he had better argue with the state. Mr. Brabants
stated he will. He will not waste any more of the Commission's time because
he really Bels this is unjustified and unrealistic.
Mr. Sherman asked, for the record, if what Mr. Brabants was saying that he
is unwilling to reconsider. Mr. Brabants stated he has reconsidered
and.....Mr. Sherman stated and would be unwilling to do further
considerations. Mr. Brabants stated the piece of land, if he could juste there
was something more the Commission was taring to protect, when they are
talking about red foxes, he realizes here he does not have much of a shot but
he feels from talking to a number of people, including attorneys and people
from the state, that this is a precedent that has not been used on a typical
building lot.
Mr. Fitzsimmons begged to differ, this is done every other week..
Mr. Rosenberg moved to reject the application, Mrs. Moore seconded.
Mr. Sherman asked, for the record, if Mr. Brabants is stating he won't
reconsider, Mr. Brabants stated he has considered. Mr. Sherman stated it is
his right to appeal.
VO E: Motion made and seconded to reject the application. Unanimous
Vote.
DENIED.
9:00 WILLOWBEND DEVELOPMENT CORP., 267 wind gate Road,
continued from 5/11/00.
VOTE, Motion made and seconded to continue the hearing to 6 July 2000
at 7:15 p.m. at the request of the applicant.
