Mr. <br /> Sherman advised this is an expansion on an addition. It was determined that <br /> there is an increase in the number of bedrooms. He was urged to look info a <br /> denitrifying system and is unwilling to do this. He should be aware if he does <br /> not include a denite in the Notice of Intent, it,would not pass. <br /> Public comment: none. <br /> 'ISE: Motion made and seconded to find positive. Unanimous vote. <br /> POSI'T'IVE DE'T'ERMINATION. <br /> 7:05 .JOSEPH GARDNER for a Determination of Applicability on the <br /> completion of a dwelling previously permitted and addition of an elevated deck <br /> at 175 Surf Drive. Eel Pesce was present with Mr. Gardner. John. Johansen <br /> stepped down from the hearing. Mr. Pesce advised in 1995- Mr. Gardner began <br /> this project. In 1996 it was approved and an order of Conditions obtained in <br /> December 1996. A building permit was pulled in March 1999. The Order has <br /> expired. <br /> The second issue is the deck in the rear. Plans were reviewed. Condition #31 <br /> t the Order referred ed to a clerk.' Mr. Gardner a nd his builder went along until <br /> this was pointed out. Mr. Rosenberg stated the deck is not shown on the plan <br /> of record. Mr. Pesce stated it was submitted with the architectural plan. <br /> Mr. Talbot asked if they are asking ing the Commission to allow the project to <br /> continue? Mr. Pesce stated it is not the fault ofMr. Gardner that the check was <br /> added. <br /> 1r. Sherman stated the plan of record showed no deck and also, it was built in <br /> August, after the order expired. <br />
