14 December 2000 <br /> Page 5. <br /> 7:25 SANE POPPONESSET BAY INC, on a proposal to dredge up to <br /> 9000 cubic yards of material within Popponesset Creek with material to <br /> be used as beach nourishment at Popponesset Spit. Norman Hayes was <br /> i present with Kevin Harrington. <br /> ` The Chair asked Mr. Hayes if he received notice that there were problems <br /> with the plans submitted? He suggested there be no presentation of <br /> evidence this evening and the hearing continued to allow them to <br /> straighten out the plans arra other matters with the Agent. <br /> k. Mr. Hayes stated throe things were identified to hire. One was the <br /> attestation of ownership that has since been found. second was the <br /> change to page one of the Notice of Intent had been submitted which was <br /> also found. The third thing was that here was no vegetation lime on the <br /> nourishment plan. Mr. Sherman Mated he did tell Mr. Hayes that these <br /> were not the only things, not a conclusive list, but mentioned that we felt <br /> there should be a delineation of beach vs dune on the plan. Also, the <br /> salt marsh is not depicted in accordance with submittal requirements. <br /> Mr. Hayes stated there are no salt marsh impacts with this project. The <br /> salt marsh at the site where they will be dredging will not be impacted <br /> and is depicted on .the plans. To address the Chair's issues, because of <br /> the importance of this project to the residents of the Town of 1lashpee <br /> and due to the fact that the' o r-ishment area that seems to be the bore <br /> of contention is a nourishment area that is currently under permit <br /> through Waterways, DEP, Army Corps and has been most recently used <br /> in 1999. The information on the plan is the exact information, with a <br /> great deal of detail, than what this Commission approved for the last <br /> dredging project from this channel. Mr. Sherman asked when that was <br /> approved? Mr. Hayes advised it was 1993. Mr. Sherman asked if that <br /> was under the Storm legs? Mr. Hayes stated it was but a full Notice of <br /> Intent was submitted. Mr. Sherman stated it was not consummated, an <br /> Order of conditions was never issued. Mr. Hayes stated there was an <br /> Order of Conditions in 1993, it is part of the Notice of Intent he <br /> submitted. Mr. Sherman stated it has expired and Mr. Hayes agreed. <br /> Because of the public safety issue and navigation issue, Mr. Hayes stated <br /> this Notice of Intent was developed after reviewing fir. Hones' response to <br /> the putrif i ation of portions of Popponesset Hay, Ockway Bair, Ann's Cove <br /> and parts of shoestring Bay. There is a window of opportunity to dredge <br /> this particular project for the Town of 1lashpee. There is a letter from <br /> the Shellfish Warden and Harbormaster,aster, acrd the Executive Secretary <br /> endorses this project. The project is designed exactly as it was permitted <br />
