i He informed the Commission he is restricted to remain within the building footprint. There is no basement space at the dwelling. The proposed shed would consist of 10 x 12 area, it is within legal limits, approval has been received from the Building Inspector. References were being made to a plan indicating the proposed location of the shed. Mr. Sherman determined from the Applicant that Board of Appeals variance is not required. Diane Boretos recommended a Negative 3 Determination. i There being no further Commission or public comment, the Chairman entertained a motion. oT o : John Johansen rade a Motion for Negative Determination; which Motion was seconded by Carel Moore and so voted unanimously. 7 -. 15-Elliot Rosenberg, for a Determination of Applicability on proposed topping of trees with maintenance in perpetuity at 1 Pontiac Road, Assessors Map 125, Block 61. Mr. Sherman explained the permit in this natter has expired, proposed work is not located within the first 50-feet, request is being rade to top some previously topped trees . Mr.. Sherr an had suggested Applicant file for a renewal as he had been unaware of said expiration of permit. He recommended a Negative Determination. The Chairman asked for clarification of "topping" . cutting off the tree tops. 1► r. Sherman explained request is being made to cut those upper branches which have grown back into the view field as result of a previous cut (vista pruning, not within the first 50-feet) . The Chairman further .inquired as to whether or not this procedure should tape place prior to March 31st in order to insure nesting for the birds. Mr. Sherman stated the cut off date to be March 1st. However, the weather having been so cold, and the landscaper agreeing to do a minimal amount of cutting within the next few days, approval was rec nmended. There being no further Commission or public comment, the Chairman entertained a motion.
