She recommended approval for the use of non-leaching wood <br /> materials for the dock. <br /> There being no Commission or public comment, the Chairman <br /> entertained a motion. <br /> MOTION: Michael Talbot made a Motion to accept the Amended <br /> Order of Conditions in this matter; which Motion was seconded by <br /> Ralph Shaw and so voted unanimously. <br /> 7 :40 Frederic Blythe to amend the Order of Conditions for SE <br /> 43 -980 to permit a revised dock location at 228 Wading Place <br /> Road, Assessors Map 222, Block 59 . <br /> The Chairman recognized Paul Whiteman, representing the <br /> Applicant, who in turn introduced Paul Rydell, land surveyor. <br /> Mr. Whiteman explained the request to amend the Order of <br /> Conditions seeks permission to relocate the dock which had been <br /> approved previously, and which has been appealed through the <br /> Zoning Board. The matter had been in litigation for a number <br /> of years, a settlement having been recently made. <br /> Request is being made to relocate the dock approximately <br /> thirty (30) to thirty-five (35) feet to the west . Mr. Whiteman <br /> apologized that the area has not yet been staked, and therefore <br /> asked for a continuance to allow for inspection. <br /> Mr. Sherman informed the Commission that he has notified <br /> Applicant that further survey work is required in order to <br /> ascertain the exact locus . <br /> Mr. Sherman then conveyed requirements expressed by the <br /> Shellfish Warden: Depth sounding at floats, two (2 ft . ) <br /> feet below mean low water depth contour, and staking. <br /> Mr. Sherman further explained to the Commission that he has <br /> informed Applicant to reduce the number of floats requested (for <br /> shellfishing purposes) , and to extend the. walkway leading to one <br /> (1) float . <br /> At this point references were being made to the plan; there <br /> was discussion regarding determinations made by the Court. <br /> Mr. Sherman noted for the Record that it is very much <br /> germane to the Conservation Commission as to the location of <br /> where people will step off, the resource area being represented <br /> and the impacts thereof. <br /> It was determined that the entire dock is to be located <br /> within Commonwealth tidelands; the step off area is a coastal <br /> beach; Applicant has been issued a Chapter 91 License. <br /> -7- <br />
