Motion was seconded by Carole Moore and so voted unanimously. <br /> 7 :40 Anil. I. Jarosiewicz for Determination of Applicability <br /> on proposed rebuild of stairs, deck, and installation of footings <br /> at 7 Manitoba ba Road, Assessors Neap 125-125 . RDA <br /> Ms. Boretos reported Applicant resides off Cape. The <br /> proposed project is located within one hundred feet of a one <br /> hundred year flood plain. <br /> There being no Commission or public comment, the Chairman <br /> entertained a motion. <br /> . <br /> MOTION: Carole Moore rade a lotion for a Negative I I I <br /> Determination; which Motion was seconded by Ralph Shaw and so <br /> voted unanimously. <br /> 7 : 4.5 Mark Weissman, 27 PeM Lane, continued from August 23, <br /> 2001. RDA <br /> Ms . Bor'etos reported on behalf of the Conservation Agent <br /> stating the proposed dock was not in compliance with the <br /> standards (length) . Mr. Sherman recommends the issuance of the <br /> RDA for the Ch. 91 plan. Applicant has the option to return and <br /> reconfigure the dock; or submit a new application for a larger <br /> dock. <br /> John Johansen clarified the dock does not conform to Ch. 91; <br /> it is much larger in size. <br /> Ms . Boretos further clarified the previous owner had been <br /> permitted structure including a ramp between the fixed pier and <br /> float that rested on the marsh at low tide. <br /> Applicant is proposing to suspend the ramp above the marsh <br /> as shown on the plan in the interest of preserving the marsh. <br /> The Conservation Agent is recommending approval of the RDA <br /> as a Negative to allow the ramp to be lifted off the marsh <br /> without enlarging the structure beyond the scope of Chi. 91 <br /> restrictions. <br /> Description of the application was reviewed by the <br /> Commissioners. ) <br /> MOTION,-- Elliot Rosenberg rade a Motion for Negative II <br /> Determination; notice to be seat to Applicant indicating that any <br /> construction in this matter shall conform strictly to license no. <br /> 8922 as approved by DEP; which Motion was seconded by Michael <br /> Talbot and so voted unanimously. <br /> 7: 50 Ernest Virgilio for Determination of Applicability on a <br /> proposed addition, repair of stone wall and replacement of grass <br /> -7- <br />
