2 . Environmental Awards - Willowbend Golf Club, Cape Cod <br /> ommission, and Horsley & Witten for their cooperation in <br /> presenting the Golf Course proposal. Mr. Sherman suggested the <br /> awards be presented at the next scheduled meeting. <br /> MOTION: Blliot Rosenberg made a Motion to present <br /> Environmental ental Awards to Willowbend. Golf Club, Cape Cod <br /> Commission, and Horsley & Witten; which Motion was seconded by <br /> Michael Talbot and so voted unanimously. <br /> . ATV - Mr. Sherman reported problems continue at the <br /> uashnet Bogs and Saraku.m t Village wetlands. The Police <br /> Department is well aware of the situation. <br /> Mr. Sherman suggested offering award monies for the <br /> identification of the violators. <br /> It was agreed to continue discussion of this natter in <br /> Executive Session. <br /> Gregory Miller, 312 Red Brook Road, continued from <br /> March 1 , 2002 . <br /> The Chairman recognized Arlene Wilson, A.M. Wilson <br /> ssociates, representing Applicant. <br /> .She provided a letter fry Massachusetts Natural Heritage, <br /> which states that in the event the Conservation Commission <br /> determines the Brook to be a regulatory river with rig erfr n <br /> area., the work cannot proceed; if it is determined the Brook is <br /> an intermittent stream with no river'front, the work may proceed <br /> under their regulations in accordance with any special conditions <br /> imposed by the Commission. <br /> - Ms. Wilson made reference to drought conditions and <br /> emergency regulations. <br /> Diane Boretos stated the Conservation Commission has ruled <br /> and delineated riverront area under both the Wetlands Protection <br /> Act and Chapter 172 within the past year. In the event Applicant <br /> was not in agreement with said determinations, an appeal should <br /> have been filed at that time. However,er, the office of General <br /> Counsel does not offer direction regarding the same filing coming <br /> back to the Commission, as denied orders of Condition are not <br /> required to be filed at the Registry of Deeds . <br /> Ms. Boretos stated it to be her professional opinion that <br /> the same project is being proposed on riverront area. <br /> References were rade to drought regulations beginning last <br /> November, this application having been filed after that t it e. <br /> Beginning in the month of November through March,, "Rivers include <br /> perennial streams which are dry during periods of extended <br /> drought.
