} A MOTION-: Carole Moore made a- Motion to Close and Issue; which motion was seconded by Leonard Pinaud and so voted unanimously. 7: 55 Philip Elia, D terminat-ion of- Applicability to construct a deck at 49 Pond Circle, Assessors Map 64, Block 73A. on behalf of the A s i s t ant Conservation ion ent, Mr. Sherman recommended a Negati 11 Determination. iTI Carole Moore made a Motion for Negative 1i Determination; which Motion was seconded by John Johansen and so voted unanimously. 8- 00 Edwarrd and Marry Coffey, 71 Meadowbrook Road, continued from May 16, 2002 . Mr. Sherman informed the Commission that an agreement has been reached that the property in question is not considered to be Riverfront. He credited Ms. Hamblin with having provided excellent research work, an understanding that the definition o "drought" had changed reverting to the 1058 definition. Mr. Sherman stated that he concurs with a letter received from Ms. Hamblin which shows that during the three months prior it did not classify as drought . At this point the Chairman recognized Lynn Hamblin who stated the emergency drought regulations have expired. 1r. Sherman stated he has contacted Heidi Davis, Task Force writing new guidance, who advised when there is a watershed of less than 160-acres, it would have to be an intermittent stream. r The 'down Planner' s office verified thy. property could not be more than fifteen 1 acres (would not sustain any flow that i could -be called river) . Ms. Hamblin clarified there will be no well on the property; Applicant will connect to Town water. Mr. Sherman recommended approval. . The Chairman recognized Diana Pontieri, who expressed her support of the project. Edward Coffey was then recognized, he asked for direction in the event Town water availability is delayed. Mr. Sherman advised hire to request an amendment to the order asking for a well. There being no further Commission or public comment, the Chairman entertained a motion, _ -
