i
Again, there is no topography/bathometric information shown
on the plan of record indicating depth underneath the proposed
float during various tides.
ms. Fantoi observed during ebbing tide not more than
twelve inches. She observed several soft shell clams from the
marsh as noted by hire activity.
Ms., Fanto i again requested this information be provided to
the Conunission for evaluation purposes.
The Nice Chairman recognized the Applicant, Mr. St. Pierre,
who stated the request for information being made, in his
opinion, "I s beyond the scope of the law which you are looking to
accomplish here" . He stated he has purchase a float based upon
the permit issued by the Harbormastet which has been installed by
a boatyard. The boat draws two and one half feet, there is
sufficient water to accommodate the float.
Applicant stated he has complied with all Conservation
Commission and Hoard of Health requirements. He reiterated the
requests being made for submission of additional information is
"beyond the law/jurisdiction", stating he is willing to do
anything within the law. He cited 100, "He Harbormaster can
provide restrictions as he shall deem necessary" .
The Connission made reference to Town counsel opinion which
states eery clearly that the impacts on resource areas are within
the jurisdiction of the Commission.
The Vice Chairman clarified the Commission has approved
permits for every float connected to the land.
Nor. Hayes stated the Harbormaster 10A float permit is the
sole permit necessary.
Again, the Nice Chairman established the Harbormaster permit
refers to the establishment of the float. The connection between
the float and the land is not permitted/approved by the
Harbormaster.
Mr. Hayes argued the walkover structure at the mean high
water line landward is before the omni s s ion the float and
associated ramp Harbormaster IOA permit) is not.
The vice Chairman responded the float and associated rnp
could not be constructed without connection to the land, which
is under Conservation Commission jurisdiction.
The Vice Chairman then asked Applicant if the permit
approved and issued by the Harbormaster includes a walkway to the
l axed.
-6-
