He <br /> believes we should be putting the issue in DEP's hands. <br /> Stephanie Jones asked if any plans or analysis have been made regarding the <br /> alternatives suggested in the corps of Engineers' letter cited by Elliot. Elliot said we <br /> have received none. <br /> Borman Hayes, ESC, said they submitted an alternative analysis to the corps of <br /> Engineers as part of the permitting process, and in that analysis they discussed the <br /> issues. The cost to construct a bridge, to dredge, do-the disposal and testing was $5 <br /> million on the north channel. The alternative to put in a box culvert at some position in <br /> the channel snacked in the face of all the studies that have been done by the Town, <br /> and the Woods Hole report in 1982 and some of the others, and any other alternative <br /> certainly isn't an option. The least environmentally damaging alternative was to <br /> maintain the channel in its current footprint of 4 minus 5 mean low water depth in <br /> accordance with the dredging that was done in 1962. The channel was first dredged in <br /> 1916, redredged in 1962, again In 1991, 1993 and most recently 2000. <br /> Michael Talbot said it's surprising that there have been alternatives presented and <br /> they've already carne to their own conclusion. <br /> Bob said we should not get involved in the alternatives now because the issue before <br /> us is an emergency certificate. He said the applicant's description of their request for <br /> this emergency certificate is adequate they've done a creditable job of following the <br /> methodology. <br /> Elliot Rosenberg said he hopes it is clear that we are doing this because of the nature <br /> of the problem, and he would be absolutely opposed if the issue ever carne up again. <br /> neighbor of the applicant referred to a letter from the Harbormaster citing a public <br /> hazard, and asked if the decision made tonight would be based on that. Bob said we <br /> cannot grant an emergency certificate under the regulations unless some public agency <br /> or official, such as the Harbormaster: declares it to be a public health and safety Issue. <br /> Motion made, seconded and unanimously carried to issue this emergency certificate <br /> contingent upon receipt of the corps of Engineers' approval, and any further dredging <br /> to be subject to the filing of a Notice of Intent. <br /> Non-Hearing Aden <br /> Old Business <br /> 1. cranberry receipts.
