• Motion made, seconded and unanimously carried to grant an extension for File 00-2 <br /> pending the Conservation Agent's review of the site to make sure that there are no <br /> violations. <br /> 4. Bob reported that he is planning to take a vacation from June 25th to July 12th, and <br /> asked if the Board would like to change the July 10th meeting to July 17th. <br /> Motion made, seconded and unanimously carried to change the Commission's <br /> July 10th meeting to July 17th. <br /> 5. Tenn expirations. Jack reported that the terms.for Elliot and himself will expire.the <br /> end of June. Bob will have Pauline send out letters to the Selectmen. <br /> 6. Enforcement Orders: <br /> Mr. Bickerstaffe. Bob reported there were nine significant landscaping violations <br /> and he recommended issuing another Enforcement Order. <br /> Mr. Coleman Captain's Road. Bob reported that a couple of years ago Mr. <br /> P P P <br /> Coleman put in a considerably larger pier than what was approved in his original <br /> Chapter 91 plan, and he never received building and wetlands permits. Supposedly he <br /> • has been retaining various engineers to get the plan done. Bob conferred with Russ <br /> Wheeler and Town Counsel, and he thinks our approach is to generate some <br /> enthusiasm for getting the permits by having the Building Department inform hirrt that if <br /> he does not do it within a certain time limit, he cannot use it. <br /> 7. Tom Smith, 266 Monomoscoy Road. Bob reported that we cited Mr. Smith for <br /> having a deck built over the work limit and ordered him to have it removed. He has not <br /> complied and has now retained P. Wightman as his attorney, who is asking for an <br /> amended order to approve the deck over the work limit. Bob said that Town Counsel <br /> confirmed that we,are under no obligation to consider an amended order. In fact if we <br /> refuse to consider it or if we issue a denial, under amended orders there is no process <br /> for appeal. Town Counsel suggested that we inform Mr. Wightman that we would <br /> entertain an amended order for those parts of the changes that are within the work limit <br /> that could be approved, but if he includes the portion over the work limit, we will not <br /> accept that amended order. <br /> Motion made, seconded and unanimously carried to inform Attorney Wightman that we <br /> will not accept any amended order request that shows work over the work limit and that <br /> does not have a correct, accurate plan. <br /> 8. Mr. Rhodes, 27 Redwood Circle. Bob said that part of this involves an emergency <br /> certification which the members will be signing tonight. He took Michael to the site. <br /> • Bob said this has been a problematical site because of run-off due to the severe winter. <br /> 0 <br />
