MASHPEE CONSERVATION COMMISSION <br /> Minutes of December 4, 2003 <br /> Public Hearing <br /> Mashpee Town Hall Meeting Room 3 <br /> Commissioners present: Jack Fitzsimmons, Chairman, Cass Costa, John Miller and <br /> Ralph Shaw. <br /> Staff present: Robert Sherman, Agent, Frances Wise, Board Secretary <br /> Jack Fitzsimmons, Chairman, called the meeting to order at 6:45 p.m. <br /> Public Hearing: Outside Consultants. Bob distributed to the members Model Rules for <br /> Hiring Outside Consultants effective July 31, 2003 and the September/October 2003 <br /> MACC Newsletter explaining it. It allows the Conservation Commission up to $25,000 <br /> per year for the hiring of consultants. Bob added paragraph 5 to the text provided to <br /> him. He recommended that the members adopt it tonight because we will undoubtedly <br /> have a legal matter on the agenda at our next meeting, and by approving it tonight we <br /> will be able to tell the applicant that they will have to pay us to get an independent <br /> verification of the issue. Bob said the approval has to be recorded in the Non-Hearing <br /> Agenda section, and these rules can be fine tuned later. <br /> Non-Hearing Agenda <br /> • <br /> Old Business: <br /> 1. RFAA-SE 43-1931 — 13 Seneca Avenue. Bob said the applicant has submitted a <br /> letter clarifying that this is a 3-bedroom house and requesting signed approval by the <br /> Commission. Bob recommended approving it and he will run the letter by Elliot before <br /> releasing it. <br /> Motion made, seconded and unanimously carried to approve this administrative <br /> approval. <br /> 2. Southport golf links. Bob said there has been a controversy with the Board of <br /> Appeals regarding a pond that was put in and was not jurisdictional for us. He said we <br /> may have discussed this, but it never made the minutes. The BOA has asked Bob to <br /> look at the pond to ascertain its status now. Bob said there are probably wetlands <br /> around it now and he will see if it is jurisdictional now. He wanted to notify the members <br /> of this before doing anything for another Board. <br /> 3. RFAA-SE 43-2088, 30 Ockway Bay Road. Bob said our regulations had stipulated <br /> the size of a boat,=and they are now requesting a permit for a new boat that is 22 '/2 feet <br /> with a 15" draft and 250 horsepower. Bob recommended approval pending Perry Ellis' <br />
