The first reason for the continuance was upon
further plan review there were some resource areas that were not delineated, and the plan needed to be
revised. The second reason for the continuance was that the walkover structure leading to Ilashpee
Wakeby Pond is going to be altered and will not be in the same footprint
Motion made,seconded and unanimously carved for a continuance until 9310612008 a@ 7:06 p.m.
John Rogers joins Commission at 7:09 p.m.
: 9p.rrn. carol Kelley,AOC—174 captain's Row
r '
(The proposed detached garage will be an attached garage and add a new gas line)
Steve Lake from Bennett Engineering stood to represent the applicant. He explained that the hearing was
continued from February 7} 2008} due to some issues vwrith a beach area on the property and the lack of
vegetated buffer strip previously conditioned in the original Iotioe of Intent. Mr. Lake explained that the
project seeks to attach the garage that was odginally detached; while it does move It closer to the
resource area, he feels there is no environmental impact. The project will also include the addition of
new gas lige on the property to be run from the street to the house, The Agent agreed that the proposed
adjustments are minor and that upon further research the, beach area was approved under another _
Conservation Agent back some years ago. The Agent explained to the Commission that the lot is almost
all turf, and he will be conducting an onsite to go over plantings with Mr. Lake to establish the vegetated
buffer strip. Thea will be some other spot mitigation on the property, and he and Mr. Lake will discuss
that as well at the onsite. Mr. Allen stated for the record that the Board of Health has the application under
review. Mr. Lake asked the Agent if he could apply for the building permit under the original Notice of
Intent, the Agent informed hire that he could. The Agent recommended approval of the amended order.
Motion made, seconded and unanimously carried to Approve the Amended order of conditions
subject to mitigation.
Motion made,,seconded and unanimously carried for a Negative Determination.
7:12 p.m. George and Elizabeth stento Trs. Mr. Slavinsk r
explained to the Commission that he did redraw the plans as requested at the last hearing. The plans
now accurately reflect the 110'foot shorter dock and the platform structure. The Agent stated that he did
appreciate the redrawn plans, but upon farther research the Town bylaws s state that no pathway to a dock
be more than 4 feet wide. The platform is 10 feet wide, acrd he sees no.need for it. It is not crucial to the
dock structure itself, The Agent also explained that this platform was discovered on a certificate of
Compliance onsite for vista pruning. The Commissioners stated that platforms have been turned down In
the past. The Commissioners also asked if there was any leeway where mitigation could be used to
2
