i <br /> x� <br /> • t <br /> The Agent explained that Mr. Seligowski"s RDA is an After-the-Fact RDA. The Agent further explained <br /> that he was called about some work on the property and during hison-site visit with the Assistant Agent <br /> found the items in question.The Agent stated that two red cedars had been removed prior to their visit, <br /> and he had inforrned Mr. seligowski that they would need to be replaced. Mr. Seligowsl i has since <br /> replaced the trees'and was allowed to do so with consent from the Agent. The Agent explained that the <br /> warn behind the pool was also discovered during the on-site inspection. Mr. Sellgowski stood to represent <br /> himself and explain the work he wished to accomplish. He acknowledged the tree removal and <br /> replacement and explained that he wanted to repair the current gall around the pool. lir. Seligowski <br /> further explained that he wished to replace the wall within.the sante footprint.The existing wall he <br /> explained is approximately 20 to 25 years old made up of }x 'timber and i deteriorating. Mr. <br /> seligowski stated that a also wanted to replace the current wall around his rotary with 18"Natural face <br /> stones. The Agent informed the Commission that the rotary area is out of Conservation jurisdiction and <br /> would not be part of the application. <br /> Motion made,seconded and unanimously carried for a negative Detennination. <br /> 7:12 p.m. James DeVincent,AOC—122 old Bdckyard ltd <br /> (continued from 05115/2008)(Landscaping and extension of patio) <br /> .carnes De Vincent stood to represent himself on his application. He explained that he YA hed to go <br /> forward with landscaping, patio extension and retaining wail replacement. Mr. DeVincernt explained that <br /> the original application was for his addition. He cines not wish to replace the grass that was removed but <br /> rather.replace it with pea stone/gravel. Mr. Deiincert did provide copies of the landscape plan. He <br /> explained than he had requested removal of a tree but could easily leave the tree if he had to. The Agent <br /> recommended the approval of the retaining wall, as it is very much needed given the slope of the bank. <br /> The Agent explained to the Commission that the application is truly three fold—One piece is the patio <br /> expansion to fit where the addition went on. The second piece being the landscaping[planting to cover. <br /> The third piece bung the cart path (pea gravel area)that Mr. Devincent originally wanted to remove a <br /> tree to install. The Agent stag that he did not want the tree to be removed as it is located at the bottom <br /> of the bank and provides some bank stabilfty. Mr. De incent agreed to sweep the dart path around the <br /> outside of the tree and initialed to that affect on the landscape plan. <br /> Motion made,seconded and urianimously carried to Approve the Amended order of Conditions <br /> with the exception of the tree removal as initialed by the applicant. <br /> 7:15 p.m. Martin Solomon, RDA—122 Popponesseft Island ltd <br /> Demolish old float system and replace within same footprint, replace gangway) <br /> Mark Burtis of Little Fiver Dock construction stood to represent the applicant. He provided the <br /> Commission with plan copies and explained that the red lines represented the proposed area and that the <br /> black were the existing system. Mr. Burtis explained that the applicant Dr. Solomon wishes to replace his <br /> existing float system within the same footprint. Mr. Burtis stated that Mr. Solomon's current system is <br /> aground at lover tide. He explained that the new system would replace the multi le dolphin piles with single <br /> 12"piles. Mr. Burns explained that the gangway would be extended so that it can strike the floats. Mr. <br /> Burtis Informed the Commission that he had spoken with both the Harbormaster and Shellfish constable <br /> and that neither had any issues with the project. He went on to further state that originally the <br /> Harbormaster was worried about channel encroachment, but Mr. Burtis Inas proven to him that,there <br /> would be none. Commissioner Fitzsimmons commented on the length I square footage of the project,the <br /> square footage is larger than permitted now but that this project would be grandfathered because it <br /> already exists. <br /> Motion made,seconded and unanimously caned for a negative Determination. <br /> 7:18 p.m.Kathleen and Brown Linga mfelter, NOI—65 sec nsett Point Road <br /> Demolish and rebuild garage with slight increase in footprint) <br /> Michael Borselli of Falmouth Engineering stood to represent the applicants. Mr. Borselli explained that the <br /> applicants wish to tear down an existing trio-car garage and rebuild it with a slight increase to the <br /> footprint. Mr. Borselli stated that the new garage will still be a two cap-but will also now include overflown <br /> 3 <br />
