Conservation Agent-Liz Leidhold <br /> The meeting was called to order by Chairman Fitzsimmons at 6:55 pm. <br /> Pre/Post Hearin ends <br /> 1) Re-vote on Keene 3-2538 (Jack Fitzsimmons,Jeff Cross, John Rogers, Ralph Shaw) <br /> This is a re-vote from the last meeting because a Commissioner recused himself after the details o <br /> the filing were presented. A yes or no vote is necessary from the Commissioners who voted <br /> during the last meeting. The project consisted of dismantling a patio and retaining wall, <br /> constructing a game room under the existing patio, rebuilding the retaining wall with concrete <br /> block and creating an addition to the house located at 27 Birch way. Mr. Cross expressed his <br /> intent to vote in the negative as he felt that the project would set a precedent for the town. <br /> Motion made and seconded. In favor-Chair Fitzsimmons, Mr. Shaw. opposed-Mr. Cross, <br /> Mr. Rogers, Request fails, applicant must re-file. <br /> 2) Administrative Approval: SE 43-2519--22 Horseshoe Bend ' ay <br /> The applicant, Joseph Carignon, rose to address the Commission. Ir. Carignon apologized for <br /> the unauthorized extension of the retaining wall. The existing wall was permitted but the <br /> extension, with the approval of the applicant's neighbor, was an effort to alleviate runoff issues <br /> onto the neighboring property. Conservation Agent McManus stated that amended orders always <br /> require abutter notification, but added that the neighbor being affected was aware of the issue. <br /> The neighbors had an agreement to build the wall in such a way that allowed space for the <br /> neighbor's walkway. The -plicant also stated that landscaping has not yet been installed and <br /> intends to landscape a econnimended by the Conservation Commission. Agent McManus <br /> reminded the applicant that Orders of Condition must be on site and no changes can be made <br /> without consulting with the Conservation Department. The Agent stated that the changes are <br /> beneficial and insignificant and offers improvement. <br /> Motion made, seconded and unanimously carried to Administratively Approve SE 43-251910 <br /> 3) Approval of Minutes from October 16, 2008 <br /> Motion made, seconded and unanimously carried to Approve the Minutes of October 16, <br /> 2008. <br /> 4) Signatures for Self Help Grant <br /> Agent McManus distributed the paperwork seeking the final round of signatures for the Self Help <br /> Grant Application. Iashpce land has been purchased, the Shields Property, which connects <br /> ownership from 1lahpee conservation laud to State Fish and wildlife. Approval from the Self <br /> Help Grant will reimburse the town up to 50% of the cost of the lot. Agent McManus offered <br /> thanks to Toni Fudala for all of his hard work in this long and tedious application process. <br /> a <br />
